本文選題：網(wǎng)絡(luò)小額多筆犯罪 + 小額多筆犯罪取證　； 參考：《政治與法律》2016年08期

【摘要】：追訴和懲罰小額多筆網(wǎng)絡(luò)及電信售假和詐騙犯罪的該當(dāng)性毋庸置疑,但實(shí)踐中常常受阻于取證的不能。其主要原因在于:印證模式及其所固守的證明標(biāo)準(zhǔn)觀念產(chǎn)生了逆向效應(yīng),固化乃至強(qiáng)化了偵查取證中的證供結(jié)合取證模式及辦案思維,漠視甚至忽視了經(jīng)由間接證據(jù)形成的證據(jù)鏈證明案件事實(shí)的取證模式。既有的取證模式以及網(wǎng)絡(luò)小額多筆犯罪的固有特點(diǎn)又使公正與效率難以協(xié)調(diào)。印證模式和現(xiàn)行證明標(biāo)準(zhǔn)觀念及其痼疾在取證中所產(chǎn)生的影響必須深究,其合理與可行的路徑應(yīng)當(dāng)是:摒棄印證模式,變革刑事證明標(biāo)準(zhǔn)的理念,強(qiáng)化間接證據(jù)的搜集,同時(shí)引入辯訴交易制度,推進(jìn)刑事司法的實(shí)行性。
[Abstract]:There is no doubt that the prosecution and punishment of small number of network and telecom fraud and fraud crimes, but the practice is often blocked by the lack of evidence. The main reason lies in the reverse effect of the confirmation mode and the concept of the standard of proof, which solidify and even strengthen the mode of evidence combining with evidence and the thinking of handling cases in the investigation and evidence collection. Ignore or even ignore the evidence chain formed by indirect evidence to prove the evidence of the facts of the case. The existing mode of obtaining evidence and the inherent characteristics of multi-crime in network make justice and efficiency difficult to coordinate. The mode of proof, the concept of current standard of proof and the influence of its chronic diseases on the collection of evidence must be deeply studied, and the reasonable and feasible ways should be: to abandon the mode of proof, to change the concept of standard of criminal proof, and to strengthen the collection of indirect evidence. At the same time, the introduction of plea bargaining system to promote the implementation of criminal justice.
