【摘要】:新《刑事訴訟法》的修改,對于我國的指定居所監(jiān)視居住這項制度重新完善,增加了檢察機關允許對特別重大賄賂犯罪采取指定居所監(jiān)視居住的相關條款,對檢察機關來說也是一項全新的檢察職能。新法不僅保留了監(jiān)視居住制度,而且在原有的制度上做出了全新的塑造,很大程度上改善了原有的制度設計上的缺陷。但是,對于改造后的制度在社會各界中仍在存在這許多的擔憂和疑慮。本文試圖從檢察機關為主體的角度切入,從理論層面和現(xiàn)實層面兩個層面進行研究,一方面對指定居所監(jiān)視居住的制度設計中存在的理論困境進行分析,發(fā)現(xiàn)其立法上的缺陷;另一方面選取W市檢察院作為實證考察對象,具體實證考察了2013年刑訴法具體實施三年以來W市檢察院適用指定居所監(jiān)視居住的實踐情況,找到其在適用指定居所監(jiān)視居住過程中存在的一些現(xiàn)實困境以及導致這些困境的具體原因。最后,針對檢察機關在適用指定居所監(jiān)視居住中存在的理論困境和操作中存在的現(xiàn)實困境,筆者提出了一些對于如何完善對指定居所監(jiān)視居住進行適用的一些宏觀構想和可操作性建議。本文的正文分為四個部分。第一部分研究了指定居所監(jiān)視居住的基礎理論。主要研究了該制度的立法沿革,經(jīng)歷了存廢之爭,到現(xiàn)在最終保留下來;接下來探析了指定居所監(jiān)視居住的法律屬性,究竟是否屬于羈押性的措施;最后對檢察機關作為司法主體適用過程中體現(xiàn)出的功能意義進行了重點的探析。第二部分著重從法律條文出發(fā),分析檢察機關如何具體適用指定居所監(jiān)視居住的制度設計。主要分析了刑訴法中第73條、74條以及最高檢《規(guī)則》中的相關司法解釋,具體包括了指定居所監(jiān)視居住的適用范圍,適用場所,檢察部門的審批程序,關于指定居所監(jiān)視居住中通知家屬和折抵刑期等等問題。第三部分主要研究了檢察機關適用指定居所監(jiān)視居住制度在實踐中出現(xiàn)的問題,以W市檢察院的實際操作情況為例,分析研究得到,在檢察機關適用的過程中,存在困境的原因包括有被異化的可能,成本過于高昂,審查監(jiān)督不夠等。第四部分是在前面及部分研究的基礎上,對于如何完善方面,特別強調(diào)了樹立保障人權理念的重要性,其必須作為其檢察機關在決定采取指定居所監(jiān)視居住時的基本原則。同時從立法完善和司法完善等角度,分別提出一些相關的構想和可操作性的建議。
[Abstract]:With the revision of the new Criminal procedure Law, the system of designated residence surveillance and residence in our country has been improved, and the relevant provisions allowing the procuratorial organs to adopt designated residence surveillance for especially serious bribery crimes have been added. To procuratorial organ also is a brand-new procuratorial function. The new law not only preserves the surveillance residence system, but also makes a new shape on the original system, which greatly improves the defects of the original system design. However, there are still many worries and doubts about the reformed system in all walks of life. From the angle of procuratorial organ as the main body, this paper tries to study from two aspects of theory and reality. On the one hand, it analyzes the theoretical dilemma existing in the system design of designated residence monitoring residence, and finds out the defects in its legislation. On the other hand, the author chooses W City Procuratorate as the object of empirical investigation, and investigates the practice of using designated residence to monitor residence for three years since the 2013 Criminal procedure Law was put into practice. Find out some practical dilemmas in the process of applying designated residence to monitor residence and the specific reasons for these difficulties. Finally, in view of the theoretical dilemma and the practical dilemma in the operation of the procuratorial organ in the application of designated residence monitoring residence, The author puts forward some macroscopical ideas and operable suggestions on how to perfect the application of designated residence monitoring residence. The text of this paper is divided into four parts. The first part studies the basic theory of designated residence monitoring. This paper mainly studies the legislative evolution of the system, has experienced the debate of saving and abolishing, and has finally retained it, and then analyzes the legal attributes of the designated residence to monitor residence, whether it is a measure of custody or not; Finally, the author analyzes the functional significance of the procuratorial organ as the judicial subject. In the second part, the author analyzes how the procuratorial organ applies the system of designated residence surveillance. The article 73 of the Criminal procedure Law and the relevant judicial explanations in the Supreme Procuratorate's rules are mainly analyzed, including the scope of application, the place of application and the examination and approval procedure of the procuratorial department, including the scope of application of the designated residence, the place of application, and the examination and approval procedure of the procuratorial department. The fourth part is based on the previous and part of the study, how to improve, especially stressed the importance of establishing the concept of human rights protection, it must be its procuratorial organs in the decision to adopt designated residence surveillance of the basic principle. At the same time, from the angle of legislative perfection and judicial perfection, this paper puts forward some related ideas and operable suggestions.
