【摘要】：中國的人權(quán)司法制度改革需以中國特色社會主義人權(quán)司法話語體系為指引。如何構(gòu)建既立足于中國國情、又符合世界人權(quán)法治保障的人權(quán)司法話語體系,需要以中國特色社會主義人權(quán)理論作為前提,堅持符合國情和遵循司法規(guī)律相結(jié)合,創(chuàng)新以人權(quán)司法觀統(tǒng)籌司法秩序觀和司法公正觀的司法價值體系,完善在刑事、民事等領域的人權(quán)司法保障制度性建設。落實在實踐中,應構(gòu)建相對獨立的司法管轄制度,重視陪審制度改革,優(yōu)化審判權(quán)監(jiān)督制度。
[Abstract]:The reform of China's human rights judicial system should be guided by the socialist human rights judicial discourse system with Chinese characteristics. How to construct a human rights judicial discourse system based on China's national conditions and in accordance with the protection of human rights and the rule of law in the world, it is necessary to combine the theory of socialist human rights with Chinese characteristics and adhere to the national conditions and the laws of justice. We should innovate the judicial value system of human rights judicial view, coordinate judicial order view and judicial justice view, perfect the system construction of human rights judicial guarantee in criminal, civil and other fields. In practice, we should construct a relatively independent judicial jurisdiction system, attach importance to the reform of the jury system, and optimize the judicial power supervision system.
