【摘要】：目前我國(guó)對(duì)于業(yè)主共益權(quán)的救濟(jì)方式只限于直接訴訟,即當(dāng)物業(yè)小區(qū)中全體業(yè)主的共益權(quán)遭到侵害時(shí),由代表全體業(yè)主的業(yè)主大會(huì)、業(yè)主委員會(huì)或物業(yè)公司向人民法院提起民事訴訟,請(qǐng)求加害人做出相應(yīng)的賠償。這種救濟(jì)方式屬于《民事訴訟法》中規(guī)定的常規(guī)訴訟模式,但是當(dāng)業(yè)主代表機(jī)構(gòu)內(nèi)部人員出現(xiàn)侵害全體業(yè)主的行為時(shí),或有人侵害全體業(yè)主的共益權(quán)但物業(yè)小區(qū)內(nèi)部救濟(jì)機(jī)構(gòu)不作為時(shí),全體業(yè)主的共益權(quán)就得不到應(yīng)有的保護(hù)。因此,建立業(yè)主共益權(quán)間接訴訟對(duì)于維護(hù)業(yè)主共益權(quán)具有十分重要的作用。通過(guò)觀察《公司法》中股東派生訴訟制度,我們發(fā)現(xiàn)此種救濟(jì)制度與業(yè)主共益權(quán)間接訴訟制度十分類(lèi)似,為業(yè)主共益權(quán)間接訴訟制度的構(gòu)建提供了借鑒作用,但是此兩者又有著很多諸如原告資格、置業(yè)時(shí)間、所占比例等具體問(wèn)題的不同之處,因此,在構(gòu)建制度時(shí)應(yīng)當(dāng)加以區(qū)分。值得注意的是,在國(guó)外公司法理論中,為了鼓勵(lì)股東提起派生訴訟,有學(xué)者提出訴訟費(fèi)用補(bǔ)償請(qǐng)求權(quán)制度,這點(diǎn)是應(yīng)當(dāng)?shù)玫街С值摹Ｔ跇I(yè)主共益權(quán)間接訴訟制度中,為了鼓勵(lì)業(yè)主維護(hù)集體利益的行為,應(yīng)當(dāng)由獲得利益的集體業(yè)主對(duì)原告的訴訟費(fèi)用進(jìn)行承擔(dān),以此將物業(yè)小區(qū)的環(huán)境引導(dǎo)到良性循環(huán)發(fā)展的道路上。
[Abstract]:At present, the remedy for the owners' common interests in our country is limited to direct litigation, that is, when the common interests of all the owners in the real estate district are infringed, the owners' Congress, which represents all the owners, Owners' committee or property company filed a civil action with the people's court, asking the offender to make corresponding compensation. This kind of relief means belongs to the normal litigation mode stipulated in the Civil procedure Law, but when the internal personnel of the representative office of the owner act against all the owners, Or when someone infringes on the co-beneficial right of all the owners but the relief organizations in the property district do not act, the co-beneficial rights of all the owners can not be protected properly. Therefore, it is very important to establish indirect litigation of owner's right of common interest for the maintenance of owner's right of common interest. By observing the shareholder derivative litigation system in Company Law, we find that this kind of relief system is very similar to the indirect litigation system of owner's right of common interest, which provides a reference for the construction of indirect litigation system of owner's right of common interest. However, there are many differences between them, such as the plaintiff's qualification, the time of purchase, the proportion of the property, and so on, so we should distinguish between them when constructing the system. It is worth noting that in foreign company law theory, in order to encourage shareholders to initiate derivative action, some scholars put forward the system of litigation cost compensation claim, which should be supported. In the indirect litigation system of owners' common interests, in order to encourage the owners to defend the collective interests, the collective owners should bear the litigation expenses of the plaintiffs. In this way, the environment of the property district to lead to a virtuous cycle of development on the road.
