本文選題：新《環(huán)境保護法》 + 環(huán)境公益訴訟　； 參考：《求索》2017年10期

【摘要】：通過對新《環(huán)境保護法》實施以來全國各地法院受理的環(huán)境公益訴訟案件的統(tǒng)計與比較分析發(fā)現(xiàn),我國環(huán)境公益訴訟發(fā)展迅速,立案數(shù)量不斷增加、受案范圍不斷擴大、被告范圍從私主體擴大到公主體、訴訟請求多樣化。但在案件受理、原告資格、結(jié)案率、結(jié)案方式等方面還存在諸多問題。面對這些問題,需要進一步完善環(huán)境司法理念,健全環(huán)境公益訴訟相關(guān)制度,確保環(huán)境公益訴訟立法步步推進,越來越趨于明確具體,可操作性不斷增強;健全環(huán)境行政監(jiān)督管理、民事環(huán)境公益訴訟與行政環(huán)境公益訴訟并駕齊驅(qū)形成合力的良性互動機制;在訴訟領(lǐng)域,要從當(dāng)前過于強調(diào)民事環(huán)境公益訴訟功效的舍本求末的做法轉(zhuǎn)變到凸顯行政環(huán)境公益訴訟與民事環(huán)境公益訴訟相結(jié)合的標本兼治的法治戰(zhàn)略上來,以更好地保護環(huán)境公共利益。
[Abstract]:Through the statistics and comparative analysis of the environmental public interest litigation cases accepted by the courts all over the country since the implementation of the new Environmental Protection Law, it is found that the environmental public interest litigation in China has developed rapidly, the number of cases on file has been increasing, and the scope of the cases has been continuously expanded. The scope of defendant extends from private subject to princess, and the claim is diversified. However, there are still many problems in case acceptance, plaintiff qualification, closing rate, closing method and so on. In the face of these problems, we need to further improve the concept of environmental justice, improve the environmental public interest litigation related system, to ensure that the environmental public interest litigation legislation is advancing step by step, more and more clear and specific, the operability is constantly enhanced; Improve the environmental administrative supervision and management, civil environmental public interest litigation and administrative environmental public welfare litigation parallel to form a positive interaction mechanism of resultant force; in the field of litigation, In order to better protect the public interests of the environment, we should change from the current practice of putting too much emphasis on the efficacy of civil environmental public interest litigation to the rule of law strategy of combining administrative environmental public interest litigation with civil environmental public interest litigation.
