【摘要】：現(xiàn)行民訴法新增加電子數(shù)據(jù)為獨立證據(jù)種類,然而卻并未針對其審查判斷規(guī)則作出規(guī)定,導致了實踐上的混亂。以電子數(shù)據(jù)屬性學說爭議的再討論為出發(fā)點,指明"七分說"與我國現(xiàn)行證據(jù)種類劃分標準內(nèi)在的邏輯契合性。以"七分說"為基礎,嘗試探討建立我國電子數(shù)據(jù)審查判斷的二元模式,具體包括電子數(shù)據(jù)證據(jù)資格審查規(guī)則的二元模式和電子數(shù)據(jù)所蘊含的證據(jù)信息證明力判定規(guī)則。其中,電子數(shù)據(jù)證據(jù)資格審查二元模式包括電子介質(zhì)的真實性審查規(guī)則,以及次種類劃分標準下所確立的特定證據(jù)資格審查規(guī)則。
[Abstract]:In the current civil procedure law, the new electronic data is added to the independent evidence, but it does not stipulate the rules for its review and judgment, which leads to the confusion in practice. Taking the re discussion of the theory of electronic data attribute theory as the starting point, it points out the logical agreement between the "seven division" and the standard of the classification of the existing evidence in China. "Seven points" On the basis of this, we try to explore the two yuan model for the establishment of electronic data review and judgment in China, including the two yuan model of the eligibility rules for electronic data evidence and the rule of evidence information proof judgment contained in the electronic data. Among them, the two element model of electronic data evidence qualification review includes the verification rules of the authenticity of the electronic media and the secondary species. The specific evidence qualification rules established under the classification criteria.
