民事執(zhí)行檢察監(jiān)督制度的實證分析與立法完善

【摘要】:執(zhí)行程序雖然是司法最后的一個環(huán)節(jié),但執(zhí)行的順利進行卻是保障司法公正的基本。為了解決執(zhí)行程序出現(xiàn)的問題,2012年民事訴訟法在修訂時特地加入了民事執(zhí)行檢察監(jiān)督制度,立法者本意通過檢察機關(guān)的介入促進法院執(zhí)行的高效運行,但由于制度較為新穎,立法規(guī)定不足,導(dǎo)致該項制度并未給出具體的操作方案。各級檢察機關(guān)手握權(quán)力卻無力行使。為了使該項制度在實際工作中得到運用,筆者為其制定了具體程序。本文開篇通過分析最高院的兩個典型案例,指出執(zhí)行檢察監(jiān)督制度的不足。然后通過分析法律條文得出我國執(zhí)行檢察監(jiān)督制度存在的具體問題,包括執(zhí)行檢察監(jiān)督的具體范圍不明確;監(jiān)督方式不統(tǒng)一;監(jiān)督方式不統(tǒng)一;監(jiān)督運行程序不完善;監(jiān)督缺乏必要的保障;監(jiān)督缺乏制約等問題。在指出存在問題的同時與案例相結(jié)合,分析問題存在的原因以及問題對制度運行的危害。最后針對上文存在的問題,結(jié)合制度問題存在的原因提出了相關(guān)的完善措施。明確了檢察監(jiān)督的具體范圍,包括執(zhí)行裁決不當(dāng)、執(zhí)行過程中不作為、執(zhí)行過程中侵害國家公共利益的行為等執(zhí)行機關(guān)違法違規(guī)的行為。同時需要強調(diào)的是,有關(guān)國家機關(guān)個人不配合執(zhí)行的行為也應(yīng)屬于執(zhí)行檢察監(jiān)督的范圍。對檢察機關(guān)的監(jiān)督方式也作出了具體規(guī)定,包括檢察建議、糾正違法通知書等。對檢察監(jiān)督制度運行程序規(guī)定的不明確的地方加以明確,檢察監(jiān)督的啟動方式,具體管轄等作出了明確規(guī)定。對民事執(zhí)行檢察監(jiān)督的保障也設(shè)置了相關(guān)的配套措施,例如調(diào)查權(quán)、檢察建議回饋等保障措施。檢察監(jiān)督權(quán)在不缺位的同時也應(yīng)做到不越位,以免對執(zhí)行權(quán)造成侵害。希望相關(guān)法律規(guī)定可以盡快出臺,彌補法律規(guī)定的不足,使民事執(zhí)行檢察監(jiān)督制度得以貫徹,檢法兩家攜手共同解決執(zhí)行程序存在的問題。
[Abstract]:The execution procedure is the last link of the judicature, but the smooth execution is the basic to guarantee the judicial justice. In order to solve the problems arising from the execution procedure, the Civil procedure Law was specially added to the Civil Enforcement Procuratorial Supervision system when it was revised in 2012. The legislators intended to promote the efficient operation of the court execution through the involvement of the procuratorial organs, but the system was relatively novel. Legislative provisions are inadequate, resulting in the system has not given a specific operation plan. Procuratorial organs at all levels hold power but are unable to exercise it. In order to make this system applied in practice, the author has made concrete procedure for it. By analyzing two typical cases of the Supreme Court, this paper points out the shortcomings of the procuratorial supervision system. Then through the analysis of the legal provisions of the implementation of procuratorial supervision system in China the existence of specific problems, including the implementation of procuratorial supervision of the specific scope is not clear, the way of supervision is not uniform, supervision operation procedures are not perfect; The supervision lacks the necessary guarantee; the supervision lacks the restriction and so on. At the same time, the author points out the existing problems and combines them with cases, and analyzes the causes of the problems and the harm of the problems to the operation of the system. Finally, according to the above existing problems, combined with the causes of the system problems, put forward the relevant improvement measures. It clarifies the specific scope of procuratorial supervision, including improper execution of the ruling, failure to act in the process of execution, acts against the public interest of the state in the process of execution, and other illegal and illegal acts of the executive organs. At the same time, it should be emphasized that the individual behavior of the relevant state organs should also belong to the scope of execution of procuratorial supervision. The supervision of the procuratorial organ has also made specific provisions, including procuratorial suggestions, correction of illegal notices and so on. This paper clarifies the unclear place of the operating procedure of the procuratorial supervision system, the starting mode and the specific jurisdiction of the procuratorial supervision system. Some relative measures have been set up for the protection of civil execution supervision, such as investigation power, procuratorial suggestion feedback and so on. Procuratorial supervision power should not be absent but also not offside, so as to avoid encroachment on executive power. I hope the relevant laws and regulations can be issued as soon as possible to make up for the deficiencies of the legal provisions, so that the procuratorial supervision system of civil execution can be carried out, and the two procuratorates will work together to solve the problems existing in the enforcement procedures.
