【摘要】：未成年人社會(huì)調(diào)查制度是2012修訂的刑事訴訟法中的一項(xiàng)新制度,該法第268條首次從立法的角度規(guī)定了社會(huì)調(diào)查制度。雖然在過去的十幾年中,各地在刑事司法實(shí)踐中一直積極試點(diǎn),探索未成年人社會(huì)調(diào)查制度,但由于這項(xiàng)制度在我國(guó)還處于探索階段,現(xiàn)行法律體系尚未能形成統(tǒng)一的模式,諸多問題仍然給理論和實(shí)踐留下了困惑和爭(zhēng)議。因此,本文擬從未成年人社會(huì)調(diào)查報(bào)告的理論基礎(chǔ)入手,通過對(duì)未成年人社會(huì)調(diào)查報(bào)告主體、內(nèi)容、程序等方面進(jìn)行深入研究,利用相關(guān)理論研究成果去分析偵查階段我國(guó)未成年人社會(huì)調(diào)查報(bào)告制度存在的問題,結(jié)合自身的工作實(shí)踐,對(duì)偵查階段未成年人社會(huì)調(diào)查報(bào)告的運(yùn)行情況進(jìn)行重新審視,發(fā)現(xiàn)和分析存在的問題,對(duì)完善偵查階段未成年人社會(huì)調(diào)查報(bào)告制度提出相關(guān)建議。
[Abstract]:The social investigation system of minors is a new system in the revised criminal procedure law of 2012. Article 268 of the law stipulates the social investigation system from the angle of legislation for the first time. Although in the past decade or so, various localities have been actively experimenting in criminal justice practice to explore the system of social investigation of minors, but because this system is still in the exploratory stage in our country, the current legal system has not yet formed a unified model. Many problems still leave confusion and controversy to theory and practice. Therefore, this paper intends to start with the theoretical basis of the social investigation report on minors, through the in-depth study of the main body, content and procedure of the social investigation report on minors. Using the relevant theoretical research results to analyze the problems existing in the social investigation report system of the minors in the investigation stage, combining with their own work practice, to re-examine the operation of the social investigation report of the minors in the investigation phase. Find and analyze the existing problems, and put forward some suggestions to improve the social investigation report system of minors in investigation stage.
