【摘要】：少年司法制度產(chǎn)生發(fā)展的內(nèi)在動力,在于通過解決未成年人犯罪問題加強社會治理。少年司法制度的基本要素包括功能要素、規(guī)則要素、主體要素以及社會支持體系。創(chuàng)設(shè)中國少年司法制度,是全面推進依法治國、實現(xiàn)司法文明的重要內(nèi)容。我國少年司法工作在法律與司法解釋制定、組織體系建設(shè)、工作機制探索等方面取得了一定成績,但仍存在一些問題,應(yīng)通過適度拓展少年司法制度的管轄范圍、制定專門少年司法法、加強組織體系建設(shè)等途徑推進我國少年司法制度的建立。
[Abstract]:The internal motive force of juvenile justice system is to strengthen social governance by solving juvenile delinquency. The basic elements of juvenile justice system include function factor, rule element, subject element and social support system. The establishment of China's juvenile justice system is an important part of comprehensively promoting the rule of law and realizing judicial civilization. China's juvenile justice has made some achievements in legal and judicial interpretation, organizational system construction, work mechanism exploration and so on. However, there are still some problems, which should be appropriately expanded the jurisdiction of the juvenile justice system. Make the special juvenile justice law, strengthen the construction of the organization system to promote the establishment of our juvenile justice system.
