【摘要】：黨的十八屆四中全會(huì)提出"推進(jìn)以審判為中心的訴訟制度改革"。刑事訴訟以審判為中心,要求訴訟活動(dòng)符合司法規(guī)律,理順偵查、檢察和審判功能的關(guān)系,確立無(wú)罪推定的原則,法庭依法獨(dú)立審判,強(qiáng)化審判功能。在法庭審判中貫徹直接言詞原則和證據(jù)裁判原則,保障被告人的辯護(hù)權(quán)、對(duì)質(zhì)權(quán)等一系列合法權(quán)利。"以審判為中心"并不意味著偵查和檢察干警的職責(zé)有所減少,也不意味著三機(jī)關(guān)的地位高低。"以審判為中心"應(yīng)當(dāng)有許多配套措施才能實(shí)現(xiàn),包括案件分流、簡(jiǎn)易審判和快速處理機(jī)制;"以審判為中心"并不意味著所有的刑事案件都必須經(jīng)過(guò)完備的審判程序。刑事案件審前分流以及簡(jiǎn)易審判等快速處理的方式正是"以審判為中心"的改革得以實(shí)現(xiàn)的條件之一。
[Abstract]:The fourth Plenary session of the 18th CPC Central Committee proposed to promote the trial-centered litigation system reform. The criminal procedure takes trial as the center, requires the lawsuit activity to conform to the judicial law, straightens out the relation between the investigation, the procuratorial work and the trial function, establishes the principle of presumption of innocence, the court tries independently according to law, strengthens the trial function. The principle of direct speech and the principle of evidence adjudication shall be implemented in the trial of the court to protect the defendant's right to defence and to pledge a series of lawful rights. " Focusing on trial "does not mean less responsibility for investigative and prosecutorial police, nor does it mean the status of the three organs." "taking trial as the center" should have many supporting measures to realize, including case diversion, summary trial and quick handling mechanism; "taking trial as the center" does not mean that all criminal cases must go through a complete trial procedure. It is one of the conditions to realize the reform of "taking trial as the center" to deal with criminal cases such as pretrial diversion and summary trial.
