【摘要】：在司法拍賣改革中,涌現(xiàn)出上海、重慶、浙江等三種典型模式,三種模式的出發(fā)點都在于順應人民法院工作信息化、公開化浪潮并根治傳統(tǒng)司法拍賣所暴露出來的弊端,卻體現(xiàn)了不同的改革理念和改革力度,社會反響也不盡相同。未來的司法拍賣改革應堅持公開、公平、公正和涉訴資產(chǎn)保值、增值的原則,妥善處理好改革創(chuàng)新與法律規(guī)定、統(tǒng)籌規(guī)范與因地制宜、傳統(tǒng)拍賣模式與網(wǎng)絡司法拍賣等三組關(guān)系,并按照"制度+科技+監(jiān)管"的總體思路,出臺網(wǎng)絡司法拍賣相關(guān)司法解釋并建立全國統(tǒng)一的涉訴資產(chǎn)處置平臺。
[Abstract]:In the reform of judicial auction, three typical models emerged, such as Shanghai, Chongqing, Zhejiang, etc. The starting point of the three models is to conform to the informationization of the work of the people's court, to open the tide and to eradicate the disadvantages exposed by the traditional judicial auction. But reflected the different reform idea and the reform dynamics, the social response is also not the same. The future judicial auction reform should adhere to the principles of openness, fairness, fairness and the preservation and appreciation of assets involved in litigation, properly handle reform, innovation and legal provisions, coordinate and standardize measures and measures in line with local conditions. The relationship between the traditional auction mode and the network judicial auction, and according to the general idea of "system science and technology supervision", the related judicial interpretation of the network judicial auction and the establishment of a unified national platform for disposition of litigant assets.
