【摘要】：在唯實體正義的訴訟理念指導下,檢察權運行不僅在訴訟構造中難以實現控辯平等,在權力格局中也難以實現有效制衡。在推進以審判為中心的訴訟改革中,不論是貫徹證據裁判原則,還是強調法院在認定事實上的決定權以及權力制約,都與現行檢察權運行之間存在張力。檢察權應當因應改變,構筑公訴主導的偵訴關系,型塑控辯平等、訴審制約的訴訟構造,建立全方位、實質性、程序性指導與持續(xù)性監(jiān)督的監(jiān)督方式。
[Abstract]:Under the guidance of the concept of only substantial justice, the operation of procuratorial power is not only difficult to realize the equality of prosecution and defense in the litigation structure, but also difficult to realize effective checks and balances in the structure of power. There is tension between the enforcement of the principle of evidence adjudication and the emphasis on the court's power to determine the fact and the restriction of power in the course of promoting the litigation reform with the trial as the center and the operation of the current procuratorial power. The procuratorial power should be adapted to the changes to construct the relationship between investigation and action led by public prosecution, to shape the equality of prosecution and defense, and to establish a comprehensive, substantive, procedural guidance and continuous supervision mode.
