【摘要】：未成年人身心發(fā)育尚不成熟,易成為犯罪分子的犯罪目標,近年來,對未成年人實施奸淫、猥褻等性侵未成年人違法犯罪活動時有發(fā)生,影響惡劣。筆者通過對已發(fā)案件的案件類型、罪名認定和案件處理情況進行分析,從犯罪主體、犯罪對象、犯罪時間、犯罪嫌疑人與被害人關(guān)系等多個方面總結(jié)了性侵未成年人犯罪案件的基本要素及特點。針對性侵未成年人犯罪案件證據(jù)的特殊性,應(yīng)從該類案件專門辦理機構(gòu)建設(shè)、堅持"一站式詢問"原則、強化證據(jù)初始收集、特殊案件個案參與等方面構(gòu)建性侵未成年人犯罪案件辦理的新型偵訴關(guān)系。
[Abstract]:Minors are not mature in their physical and mental development, and they are easy to be the criminal target of criminals. In recent years, committing adultery and indecency to minors has occurred from time to time with bad influence. By analyzing the types of cases, the identification of charges and the handling of cases, the author analyzes the subject of the crime, the object of the crime, the time of the crime, The relationship between suspect and victim summarizes the basic elements and characteristics of crimes against minors. The particularity of evidence in cases of sexual assault of minors should be handled specially from this kind of cases, adhere to the principle of "one-stop inquiry", and strengthen the initial collection of evidence. The special cases involved in such aspects as the establishment of sexual assault juvenile crime cases handling a new type of investigation and litigation relationship.
