我國(guó)《行政復(fù)議法》與《行政訴訟法》的沖突與協(xié)調(diào)問(wèn)題研究

【摘要】:行政復(fù)議與行政訴訟作為我國(guó)兩種行政救濟(jì)制度,在行政救濟(jì)體系中占主要地位。其中行政復(fù)議表現(xiàn)為準(zhǔn)司法性,兼具司法特征和行政特征;行政訴訟具有司法性。二者實(shí)踐中均承擔(dān)救濟(jì)權(quán)利、解決糾紛和監(jiān)督行政的重要功能。準(zhǔn)確界定行政復(fù)議和行政訴訟的性質(zhì)和功能是運(yùn)行兩個(gè)制度的前提和基礎(chǔ)。只有這樣,行政復(fù)議與行政訴訟在制度設(shè)計(jì)和司法實(shí)踐中才能分工協(xié)作,互相配合,互相協(xié)調(diào),共同解決行政糾紛。隨著2015年新《行政訴訟法》的頒布實(shí)施,其同我國(guó)現(xiàn)行《行政復(fù)議法》之間的沖突便愈演愈烈,一方面體現(xiàn)為二者制度和實(shí)踐層面的合理“沖突”,這類“沖突”的存在并不會(huì)造成行政復(fù)議制度和行政訴訟制度的運(yùn)行障礙,其誕生的原因來(lái)自制度彼此的獨(dú)立性。作為兩個(gè)獨(dú)立的救濟(jì)手段,二者承擔(dān)的責(zé)任不盡相同。為體現(xiàn)各自的優(yōu)勢(shì),在制度設(shè)計(jì)上必然要有所體現(xiàn)。另一方面體現(xiàn)為不合理的沖突,這類沖突使得實(shí)踐過(guò)程中,行政復(fù)議和行政訴訟就相同問(wèn)題基于不一致的法律規(guī)定發(fā)生不同效果。沖突中既包含兩種制度長(zhǎng)久以來(lái)存在的沖突,也包括在社會(huì)發(fā)展過(guò)程中兩種制度暴露出的沖突。這些沖突有其存在的原因,不僅存在制度層面立法技術(shù)上的原因,還存在實(shí)踐操作層面人員制度方面的現(xiàn)實(shí)問(wèn)題。這些不合理沖突將會(huì)對(duì)制度的運(yùn)行造成不容忽視的消極影響,可能分裂兩種制度間的密切聯(lián)系,阻礙兩種制度各自內(nèi)在優(yōu)勢(shì)的發(fā)揮,使得行政糾紛難以解決,行政救濟(jì)效率低下,進(jìn)而減損法律救濟(jì)措施在公民心中的地位,喪失法律制度的權(quán)威性。是以,必須協(xié)調(diào)好《行政復(fù)議法》和《行政訴訟法》之間的關(guān)系。在《行政復(fù)議法》面臨修改之際,為了更好的平衡兩種制度的關(guān)系,在協(xié)調(diào)二者關(guān)系的理論基礎(chǔ)上,針對(duì)二者在制度和實(shí)踐上的具體沖突,提出具體的立法建議和解決措施,引導(dǎo)《行政復(fù)議法》的修改方向,達(dá)到《行政復(fù)議法》與《行政訴訟法》完美平衡的立法狀態(tài),促使二者各司其職,成為行政救濟(jì)體系的中流砥柱,從而更好地保護(hù)公民、法人和其他組織的合法權(quán)益,助力構(gòu)建社會(huì)主義法治國(guó)家。
[Abstract]:Administrative reconsideration and Administrative Litigation, as two kinds of administrative relief system in China, occupy the main position in the administrative relief system. The performance of administrative review is quasi-judicial, judicial and administrative, and administrative litigation is judicial. Both of them undertake the important function of relief right, dispute resolution and administrative supervision in practice. Accurately defining the nature and function of administrative reconsideration and administrative litigation is the premise and foundation of running the two systems. Only in this way can administrative reconsideration and administrative litigation work together in system design and judicial practice, cooperate with each other, coordinate with each other, and resolve administrative disputes together. With the promulgation and implementation of the new Administrative procedure Law in 2015, the conflict between it and the current Administrative Review Law of our country becomes more and more intense. On the one hand, it is reflected in the reasonable "conflict" between the two systems and practice. The existence of this kind of "conflict" will not cause the administrative reconsideration system and the administrative litigation system to operate the obstacle, its birth reason comes from the system each other's independence. As two independent relief means, they bear different responsibilities. In order to reflect their advantages, the system design must be reflected. On the other hand, it is reflected in unreasonable conflicts, which make administrative reconsideration and administrative litigation have different effects on the same issues based on inconsistent legal provisions in the process of practice. The conflict includes both the conflicts that exist for a long time in the process of social development and the conflicts exposed by the two systems in the process of social development. These conflicts have their own reasons, not only the technical reasons of legislation at the institutional level, but also the practical problems in the personnel system at the operational level. These unreasonable conflicts will have a negative impact on the operation of the system, which may divide the close relationship between the two systems, hinder the exertion of their respective internal advantages, and make the administrative disputes difficult to resolve. The low efficiency of administrative relief detracts from the status of legal relief measures in the minds of citizens and loses the authority of the legal system. Therefore, we must coordinate the relationship between the Administrative Review Law and the Administrative procedure Law. In order to balance the relationship between the two systems, in order to better balance the relationship between the two systems, on the basis of the theory of coordinating the relationship between the two systems, and aiming at the specific conflicts between the two systems and practices, the author puts forward specific legislative suggestions and solutions. To guide the direction of the revision of the Administrative Review Law, to reach the legislative state of perfect balance between the Administrative Review Law and the Administrative procedure Law, to urge them to perform their respective duties, and to become the mainstay of the administrative relief system, thereby better protecting citizens, The legal rights and interests of legal persons and other organizations help to build a socialist country ruled by law.
