【摘要】：檢察權(quán)運(yùn)行結(jié)構(gòu)化,指基于檢察權(quán)的監(jiān)督屬性和訴訟職能,檢察權(quán)在運(yùn)行中呈現(xiàn)的權(quán)力運(yùn)行各要素之間相互耦合、整體作業(yè)的特點(diǎn),包括檢察權(quán)運(yùn)行所遵循的上下一體和相互制約,按照各種職能屬性形成不同的權(quán)力運(yùn)行組織方式以及這些組織方式之間的相互協(xié)調(diào)、約束與影響。通過對(duì)檢察權(quán)運(yùn)行各要素的結(jié)構(gòu)化解讀,剖析檢察權(quán)運(yùn)行結(jié)構(gòu)化的表現(xiàn)和特征,有助于實(shí)現(xiàn)檢察改革的適度司法化,促成檢察資源優(yōu)化配置,完善檢察權(quán)運(yùn)行的動(dòng)態(tài)互控,進(jìn)而有利于建立職權(quán)配置更為合理、運(yùn)行更為順暢、更加公正高效的檢察權(quán)運(yùn)行機(jī)制。
[Abstract]:The operation structuralization of procuratorial power refers to the characteristics of the operation of procuratorial power based on its supervisory attributes and litigation functions, and the coupling between the elements of the operation of the procuratorial power and the operation of the procuratorial power, as well as the characteristics of the whole operation. Including the procuratorial power operation followed by the upper and lower body and mutual constraints, according to the various functional attributes of the formation of different power operation of the organization and the coordination between these organizational ways, constraints and influences. Through the structural interpretation of the elements of procuratorial power operation, this paper analyzes the structural performance and characteristics of procuratorial power operation, which is helpful to realize the moderate judicial reform of procuratorial reform, to promote the optimal allocation of procuratorial resources, and to perfect the dynamic mutual control of procuratorial power operation. Thus, it is helpful to establish a more reasonable power allocation, more smooth operation and more fair and efficient running mechanism of procuratorial power.
