論我國未成年人刑事和解之轉(zhuǎn)型——基于實踐的理論分析

【摘要】:與西方刑事和解起源于少年司法實踐不同,我國的未成年人刑事和解是在刑事司法的現(xiàn)實難題和政治使命背景下,主要作為輕微刑事案件辦理機制展開的。它以補償被害人的物質(zhì)需求為基本導向,被害人心理修復和加害恢復的目標一定程度上被置之不問。在此框架下展開的未成年人刑事和解的獨特性被消解了,在政策理念、制度設計、程序結(jié)構(gòu)和標準設定上都與成年人刑事和解無異,呈現(xiàn)為混合/補償模式。基于此,有必要在考察西方實踐經(jīng)驗的基礎上,以恢復性司法和未成年人司法雙重理念為指引,推進我國未成年人刑事和解的轉(zhuǎn)型,即實現(xiàn)向?qū)iT/教化模式的轉(zhuǎn)換。
[Abstract]:Different from the western criminal reconciliation originated from the practice of juvenile justice, the criminal reconciliation of minors in our country is under the background of the realistic difficult problem and political mission of criminal justice. Mainly as a mechanism for handling minor criminal cases. It is guided by the material needs of the victims. To some extent, the targets of psychological rehabilitation and victimization recovery of the victims have been ignored. The uniqueness of the criminal reconciliation of minors launched under this framework has been dispelled, and the policy ideas and system design have been eliminated. The procedure structure and standard setting are no different from that of adult criminal reconciliation, and present a mixed / compensatory model. Based on this, it is necessary to take the dual concept of restorative justice and juvenile justice as the guide on the basis of reviewing the western practical experience. To promote the transformation of criminal reconciliation of minors in our country, that is, to realize the conversion to the mode of specialization / education.
