【摘要】：行政訴訟體制有以司法機(jī)關(guān)掌握行政審判權(quán)的司法審查體制以及以專(zhuān)門(mén)機(jī)關(guān)掌握行政審判權(quán)的行政裁判體制之分,其原因在于如何認(rèn)識(shí)司法權(quán)與行政權(quán)的分立與制衡。民國(guó)初年法制建設(shè)過(guò)程受?chē)?guó)外行政訴訟理論的傳播,立法者的知識(shí)背景、自身利益等因素的影響,南京臨時(shí)政府時(shí)期、國(guó)會(huì)制憲時(shí)期以及北洋政府統(tǒng)治初期均確立了各不相同的行政訴訟體制,呈現(xiàn)出自上而下的法制建設(shè),制度的選擇易受立法者自身偏好影響的特點(diǎn)。
[Abstract]:The administrative litigation system includes a judicial review system in which the judicial organs hold the administrative jurisdiction and an administrative adjudication system in which the specialized organs hold the administrative jurisdiction. The reason lies in how to understand the separation and balance of judicial power and executive power. The process of legal system construction in the early period of the Republic of China was influenced by the spread of foreign administrative litigation theory, the knowledge background of legislators, the self-interest and so on, during the period of Nanjing Provisional Government. During the constitution-making period of Congress and the early period of the Beiyang government, different administrative litigation systems were established, showing the legal construction from top to bottom, and the choice of the system was easily influenced by the preference of the legislators themselves.
