行政相對人的程序權(quán)利研究

【摘要】:我國行政法中有關(guān)程序法的內(nèi)容才剛剛開始起步,以前行政法一直忽略了程序權(quán)利的內(nèi)容,所以在行政相對人的程序權(quán)利的實(shí)施過程中就沒有具體的保障措施。目前在行政法里已經(jīng)初步的對行政相對人的程序權(quán)利的內(nèi)容進(jìn)行了法律規(guī)定和研究,在《中華人民共和國行政訴訟法》,《中華人民共和國行政處罰法》,《中華人民共和國行政復(fù)議法》出臺之后,中國法制史中關(guān)于缺失公民權(quán)利受程序權(quán)利保護(hù)這部分的內(nèi)容有了新的發(fā)展。但是,我國還沒有一部完整的行政程序法典,當(dāng)行政相對人的程序權(quán)利受到侵犯,需要司法保護(hù)的時(shí)候,只等在上述行政法律法規(guī)中找尋與程序有關(guān)的法律規(guī)定進(jìn)行判決,可面對強(qiáng)大的行政主體,行政相對人則屬于弱勢群體,只有確立了真正的行政程序權(quán)利,才能有效的保護(hù)行政相對人的合法權(quán)益。而確立行政程序法,就要考慮很多因素,例如行政法中的程序權(quán)利與實(shí)體權(quán)利是相互聯(lián)系在一起的,實(shí)體權(quán)利是明確規(guī)定的一種靜態(tài)的權(quán)利,可是程序權(quán)利是為了實(shí)體權(quán)利得到有效的實(shí)施而設(shè)定的程序性的步驟,是一種動(dòng)態(tài)的權(quán)利,所以要把程序權(quán)利和實(shí)體權(quán)利之間的關(guān)系進(jìn)行研究。由于行政相對人的程序權(quán)利不是很完善,在實(shí)際運(yùn)用過程中沒有合理的救濟(jì)途徑,所以本文將從完善行政相對人的權(quán)利角度進(jìn)行探討。
[Abstract]:The content of procedural law in administrative law of our country has just begun to start, and the content of procedural right has been neglected in administrative law before. Therefore, there are no specific safeguards in the process of implementing the procedural rights of the administrative counterpart. At present, the content of the procedural rights of the administrative counterpart has been preliminarily stipulated and studied in the administrative law. After the promulgation of the Administrative procedure Law of the people's Republic of China, the Administrative punishment Law of the people's Republic of China and the Administrative Review Law of the people's Republic of China. In the history of Chinese legal system, there has been a new development in the content of the lack of civil rights protected by procedural rights. However, there is not a complete administrative procedural code in China, when the procedural rights of administrative counterparts are infringed. When the need for judicial protection, only in the above administrative laws and regulations in search of the procedures related to the legal provisions to judge, can face a strong administrative subject, the administrative counterpart is a vulnerable group. Only when the real right of administrative procedure is established, can the legitimate rights and interests of administrative counterpart be effectively protected. In order to establish the law of administrative procedure, a lot of factors should be considered. For example, procedural rights and substantive rights in administrative law are interrelated, and substantive rights are a kind of static rights that are clearly stipulated. However, procedural rights are the procedural steps set for the effective implementation of substantive rights, which is a kind of dynamic rights. Therefore, we should study the relationship between procedural rights and substantive rights. Because the procedural rights of administrative counterpart are not very perfect, there is no reasonable remedy in the process of practical application. So this paper will discuss from the angle of perfecting the right of administrative counterpart.
