【摘要】：隨著法院執(zhí)行案件的增多，法院在辦案過程中又遇到了新的難題——即被執(zhí)行人通過與案外人惡意串通，訂立虛假租賃合同來規(guī)避執(zhí)行。執(zhí)行過程中簽訂的虛假租賃合同不同于一般的租賃合同，我國法律對一般的租賃合同有明確地規(guī)定，而對這種虛假租賃合同還沒有專門的規(guī)定，只是將其籠統(tǒng)地歸為妨害執(zhí)行的行為而給予相應(yīng)的處罰。但是，這種處罰并不能有效遏制簽訂虛假租賃合同來規(guī)避執(zhí)行的行為。因此，本文試著分析原因，發(fā)現(xiàn)問題，并借鑒其他國家和地區(qū)的法律規(guī)制，制定出能夠有效遏制虛假租賃現(xiàn)象的法律規(guī)范，保障債權(quán)人合法權(quán)益，，完善我國租賃合同法律體系，健全社會主義法律制度，使我國的法制建設(shè)朝著健康有序的方向發(fā)展。
[Abstract]:With the increasing number of cases executed by the court, the court encountered a new difficulty in the course of handling the case-that is, the executor colluded maliciously with outsiders in the case. Conclusion of false lease contract to avoid execution. The false lease contract signed in the process of execution is different from the general lease contract. The law of our country has a clear stipulation on the general lease contract, but there is no special provision for this kind of false lease contract. However, this kind of punishment can not effectively restrain the behavior of signing false lease contract to avoid execution. Therefore, this paper tries to analyze the reasons and find out the problem. And draw lessons from the legal regulations of other countries and regions, formulate legal norms that can effectively curb the phenomenon of false lease, protect the legitimate rights and interests of creditors, perfect the legal system of leasing contracts in our country, and perfect the socialist legal system. Make the legal system construction of our country develop healthily and orderly.
