【摘要】：現(xiàn)行的未成年人刑事處遇以監(jiān)禁刑為主導(dǎo),非監(jiān)禁刑及非刑罰處遇措施不夠豐富,教養(yǎng)處遇存在立法規(guī)制不足、實(shí)際操作散亂等問題。因此,在廢除了勞動(dòng)教養(yǎng)制度的大背景下,應(yīng)當(dāng)以法治化、人性化、社會(huì)化和多樣化為方向,推動(dòng)未成年人刑事處遇制度的改革,并重點(diǎn)推進(jìn)未成年人教養(yǎng)處遇的立法完善,加快收容教養(yǎng)、工讀教育等制度的改革,使之適應(yīng)犯罪治理和未成年人再社會(huì)化的需要。
[Abstract]:The current juvenile criminal punishment is dominated by imprisonment penalty, the non-custodial punishment and non-penalty punishment measures are not rich enough, the penitentiary department has some problems, such as inadequate legislative regulation, scattered actual operation and so on. Under the background of abolishing the reeducation through labor system, we should take the rule of law, humanization, socialization and diversification as the direction to promote the reform of the juvenile criminal treatment system. It also puts emphasis on promoting the legislative perfection of the juvenile correctional service, speeding up the reform of the system of reception and upbringing, work-study education, and so on, so as to adapt it to the needs of crime management and the re-socialization of minors.
