港口經(jīng)營(yíng)人責(zé)任限制法律問(wèn)題研究

【摘要】:由于《港口法》僅調(diào)整港口行政法律關(guān)系,《海商法》和其他調(diào)整民事主體的法律都沒(méi)有專門(mén)對(duì)港口經(jīng)營(yíng)人民事法律關(guān)系做出規(guī)定,在司法實(shí)踐中出現(xiàn)貨主因貨損起訴港口經(jīng)營(yíng)人要求賠償?shù)闹T多糾紛,其核心爭(zhēng)議點(diǎn)大部分集中于港口經(jīng)營(yíng)人是否有權(quán)限制賠償責(zé)任。學(xué)者們也對(duì)港口經(jīng)營(yíng)人法律地位及是否有權(quán)限制賠償責(zé)任發(fā)表見(jiàn)解。本文擬將港口經(jīng)營(yíng)人置于海上貨物運(yùn)輸法律關(guān)系中,在清晰界定港口經(jīng)營(yíng)人法律地位的基礎(chǔ)上,通過(guò)對(duì)國(guó)際公約和國(guó)內(nèi)法的研究淺析港口經(jīng)營(yíng)人責(zé)任限制問(wèn)題的國(guó)際立法趨勢(shì),探討我國(guó)明確港口經(jīng)營(yíng)人責(zé)任限制的合理性,進(jìn)而探索我國(guó)港口經(jīng)營(yíng)人責(zé)任限制的最佳解決途徑。 全文分為引言、正文和結(jié)語(yǔ)三大部分,其中正文又分六部分: 第一部分主要介紹港口經(jīng)營(yíng)人的定義和賠償責(zé)任限制定義及分類 第二部分主要介紹了港口經(jīng)營(yíng)人法律地位的幾種學(xué)說(shuō),目的是明確港口經(jīng)營(yíng)人的法律地位,為下文探討在相關(guān)立法中法律地位確立和享有責(zé)任限制權(quán)利做鋪墊。 第三部分主要討論在國(guó)際公約和國(guó)內(nèi)法中港口經(jīng)營(yíng)人法律地位的界定和對(duì)港口經(jīng)營(yíng)人享有單位責(zé)任限制權(quán)利的分析。 第四部分主要討論在相關(guān)立法中港口經(jīng)營(yíng)人法律地位的界定和港口經(jīng)營(yíng)人能否享有綜合責(zé)任限制權(quán)利(海事賠償責(zé)任限制)。 第五部分主要分析我國(guó)明確港口經(jīng)營(yíng)人責(zé)任限制的必要性。 第六部分主要尋求我國(guó)港口經(jīng)營(yíng)人責(zé)任限制問(wèn)題的最佳解決之道;通過(guò)探討明確港口經(jīng)營(yíng)人責(zé)任限制各種可能途徑的可行性,認(rèn)為在《海商法》中單獨(dú)規(guī)定與承運(yùn)人責(zé)任限制相一致的港口經(jīng)營(yíng)人責(zé)任限制權(quán)利,是解決我國(guó)港口經(jīng)營(yíng)人責(zé)任限制問(wèn)題最合理、最有效的途徑。
[Abstract]:Since the Port Law only regulates the administrative and legal relations of ports, neither the Maritime Law nor other laws regulating civil subjects specifically regulate the legal relationship between the people in port operations, In judicial practice, there are many disputes in which shippers sue port operators for damages. Most of the disputes are focused on whether the port operators have the right to limit the liability for compensation. Scholars have also expressed their views on the legal status of port operators and whether they have the right to limit liability. Based on the clear definition of the legal status of the port operator, this paper intends to put the port operator in the legal relationship of the carriage of goods by sea, and analyzes the trend of international legislation on the limitation of the liability of the port operator through the study of international conventions and domestic laws. This paper discusses the rationality of the limitation of the port operator's liability in our country, and then probes into the best way to solve the limitation of the port operator's liability in our country. The full text is divided into three parts: introduction, text and conclusion. The main body is divided into six parts: the first part mainly introduces the definition of the port operator and the definition and classification of liability limitation. The second part mainly introduces several theories of the legal status of the port operator. The purpose of this paper is to clarify the legal status of the port operator and to lay the groundwork for the establishment and enjoyment of the right of limitation of liability in the relevant legislation. The third part mainly discusses the definition of the legal status of port operators in international conventions and domestic laws and the analysis of the rights of port operators to enjoy the limitation of unit liability. The fourth part mainly discusses the definition of the legal status of the port operator in the relevant legislation and whether the port operator can enjoy the right of comprehensive liability limitation (limitation of maritime compensation liability). The fifth part mainly analyzes the necessity of defining the limitation of port operator's liability in our country. The sixth part mainly seeks the best way to solve the problem of the limitation of the port operator's liability in our country; By exploring the feasibility of clarifying the various possible ways to limit the liability of the port operator, it is considered that the limitation right of the liability of the port operator, which is consistent with the limitation of the carrier's liability, is separately stipulated in the Maritime Code, It is the most reasonable and effective way to solve the limitation problem of port operator's liability in our country.
