【摘要】：歷經(jīng)二十余年的中國經(jīng)濟(jì)法之爭,是中國現(xiàn)代法制史上的重大歷史事件,并將成為當(dāng)代中國法學(xué)研究和法學(xué)教育的基礎(chǔ)性、前沿性課題。中國經(jīng)濟(jì)法之爭有其豐富的內(nèi)涵,相關(guān)的探討可使其輪廓逐步清晰,便于認(rèn)識和把握;中國經(jīng)濟(jì)法之爭有其發(fā)生發(fā)展的必然性。其中,大陸法注重法體系構(gòu)建和法部門劃分傳統(tǒng)的深重影響,以及經(jīng)濟(jì)法與民商法、行政法在中國的“不期而遇”,是導(dǎo)致這場爭論的客觀緣由。
[Abstract]:The controversy over China's economic law, which has lasted for more than 20 years, is an important historical event in the history of China's modern legal system, and will become a fundamental and frontier topic in contemporary China's legal research and legal education. Among them, the civil law pays attention to the construction of the legal system and the profound influence of the tradition of dividing the legal departments, as well as the "unexpected encounter" between economic law and civil and commercial law, and administrative law in China, which is the objective cause of this dispute.
