【摘要】：從我國三種專利保護(hù)客體模式設(shè)置的背景入手,闡述了我國三種專利保護(hù)客體并行是為了鼓勵(lì)發(fā)明創(chuàng)造;指出其特點(diǎn)是:三種客體用同一部專利法來規(guī)定、實(shí)用新型和外觀設(shè)計(jì)保護(hù)對(duì)象針對(duì)的都是產(chǎn)品、發(fā)明和實(shí)用新型的界限比較模糊。從立法模式等三個(gè)方面分析新科技革命對(duì)三種專利保護(hù)客體模式的挑戰(zhàn),并提出應(yīng)對(duì)之策,即現(xiàn)階段對(duì)實(shí)用新型和外觀設(shè)計(jì)制度進(jìn)行適當(dāng)調(diào)整;從長(zhǎng)遠(yuǎn)來看,加強(qiáng)對(duì)實(shí)用新型和外觀設(shè)計(jì)制度的研究,逐步積累條件,逐步推動(dòng)實(shí)用新型和外觀設(shè)計(jì)單獨(dú)立法。
[Abstract]:Starting from the background of the setting of three kinds of patent protection object modes in our country, this paper expounds that the parallel purpose of the three kinds of patent protection objects in our country is to encourage invention and creation, and points out that the three kinds of objects are stipulated by the same patent law, the utility model and the design protection object are all aimed at the product, and the boundary between the invention and the utility model is relatively vague. This paper analyzes the challenges of the new scientific and technological revolution to the three modes of patent protection object from three aspects, such as the legislative mode, and puts forward some countermeasures, that is, to adjust the utility model and the design system properly at the present stage, and to strengthen the research on the utility model and the design system in the long run, accumulate the conditions step by step, and gradually promote the separate legislation of the utility model and the design.
