【摘要】：2011年7月,我國啟動著作權(quán)法第三次修訂,文章針對本次修訂所引入的孤兒作品和三步檢驗法,結(jié)合近幾年世界主要國家關(guān)于圖書館著作權(quán)限制與例外的修訂,探究美國、歐盟、加拿大和日本孤兒作品立法的共通性和差異性以及三步檢驗法在我國的適用性。梳理圖書館著作權(quán)限制與例外制度在現(xiàn)今立法趨勢下,所受到的制約因素及未來調(diào)整的方向,進(jìn)而在實踐層面上,確立圖書館著作權(quán)限制與例外立法的戰(zhàn)略需求、目標(biāo)與實現(xiàn)路徑,為圖書館實務(wù)中著作權(quán)限制與例外的適用提供參考引證。
[Abstract]:In July 2011, our country started the third revision of the copyright law. The article is aimed at the orphan works and the three-step test method introduced in this revision, in combination with the revision of the limitation and the exception of the copyright of the library in the major countries of the world in recent years, and probes into the US and the EU. The applicability of the three-step test method in the legislation of the orphan works in Canada and Japan. By combing the limitation of the copyright of the library and the direction of the adjustment in the future under the current legislative trend, this paper, on the practical level, establishes the strategic demand, the goal and the realization path of the copyright restriction and the exception legislation of the library. It provides a reference for the application of the limitation and the exception of the copyright in the library practice.
