【摘要】：人格權(quán)獨立成編,既是民法典體例問題,更是一個關(guān)系中國民法典能否適應(yīng)現(xiàn)代中國社會的根本問題。德國人格權(quán)模式以人格和侵權(quán)來解決人格權(quán)問題,反映的是百年前的社會狀況,完全不能適應(yīng)現(xiàn)代社會尤其是現(xiàn)代中國的需要。只有人格權(quán)獨立成編,才能充分容納現(xiàn)代中國的人格權(quán)問題,才能科學(xué)規(guī)定現(xiàn)代中國的具體人格權(quán),才能合理保護(hù)現(xiàn)代中國的人格利益。人格權(quán)獨立成編,不僅可以改變德國人格權(quán)模式的體例,解放人格權(quán)發(fā)展的空間,而且也可以改變德國人格權(quán)模式的邏輯,將權(quán)利確認(rèn)和防止侵權(quán)并重�！度烁駲�(quán)法學(xué)者建議稿》的問世顯示人格權(quán)獨立成編完全可行,當(dāng)然也有不少缺點,期望國家立法機(jī)關(guān)勇于承擔(dān)歷史責(zé)任,自覺追求民法典現(xiàn)代化和中國化,盡快將人格權(quán)編納入立法計劃。
[Abstract]:The independent compilation of the right of personality is not only a matter of civil code style, but also a fundamental problem related to whether the civil code of China can adapt to the modern Chinese society. The German model of personality right solves the problem of personality right by personality and tort, which reflects the social condition of 100 years ago and can not meet the needs of modern society, especially modern China. Only if the right of personality is compiled independently, can the problem of personality right of modern China be fully accommodated, the specific personality right of modern China can be stipulated scientifically, and the interests of personality of modern China can be reasonably protected. The independent formation of the personality right can not only change the style of the German personality right model, but also change the logic of the German personality right model as well as the space for the development of the right to liberate the personality right. Putting equal emphasis on the recognition of rights and the prevention of infringement. The publication of the draft of the Scholars' recommendations on the Law of personal Rights shows that the independent compilation of personality rights is completely feasible, and of course there are many shortcomings. It is expected that the national legislature will have the courage to assume historical responsibilities. Consciously pursue the modernization and Sinicization of the Civil Code and incorporate personality rights into the legislative plan as soon as possible.
