【摘要】："注意力"經(jīng)濟(jì)之下,各大視頻網(wǎng)站逐漸加大對(duì)優(yōu)質(zhì)視頻版權(quán)采購(gòu)、服務(wù)器與帶寬擴(kuò)容等方面的投入。定向搜索聚合技術(shù)在移動(dòng)端的應(yīng)用使得移動(dòng)視頻聚合應(yīng)用經(jīng)營(yíng)者迅速發(fā)展,但是,其對(duì)網(wǎng)絡(luò)視頻產(chǎn)業(yè)健康有序發(fā)展帶來了諸多困擾。移動(dòng)視頻聚合應(yīng)用存在諸多法律問題,集中表現(xiàn)為應(yīng)用經(jīng)營(yíng)者的信息網(wǎng)絡(luò)傳播權(quán)侵權(quán)與不正當(dāng)競(jìng)爭(zhēng)。本文討論了在現(xiàn)有司法環(huán)境下類型化移動(dòng)視頻聚合應(yīng)用經(jīng)營(yíng)者侵權(quán)行為,并討論應(yīng)用經(jīng)營(yíng)者的法律定性,以期明確應(yīng)用經(jīng)營(yíng)者法律責(zé)任,維護(hù)網(wǎng)絡(luò)視頻行業(yè)權(quán)利人的合法權(quán)益與良性市場(chǎng)秩序。
[Abstract]:Under the "attention" economy, the major video websites gradually increase their investment in high-quality video copyright procurement, server and bandwidth expansion. The application of directed search aggregation technology in mobile terminal makes the operator of mobile video aggregation application develop rapidly, but it brings a lot of trouble to the healthy and orderly development of network video industry. There are many legal problems in the application of mobile video aggregation, which focus on the infringement and unfair competition of the information network communication right of the application operator. This paper discusses the tort of the application operator of typed mobile video aggregation under the existing judicial environment, and discusses the legal characterization of the application operator in order to clarify the legal liability of the application operator. Maintain the legal rights and interests of the right holders of the network video industry and healthy market order.
