【摘要】：我國(guó)雖然沒有在法律中規(guī)定自甘風(fēng)險(xiǎn),司法實(shí)踐中卻已經(jīng)有對(duì)自甘風(fēng)險(xiǎn)的運(yùn)用。為了使該類案件的適用不再混亂,有必要在法律中明確規(guī)定自甘風(fēng)險(xiǎn)。從真實(shí)案例出發(fā),選取了38個(gè)案件,比較分析其適用的肯定判例和否定判例,總結(jié)自甘風(fēng)險(xiǎn)適用的領(lǐng)域和條件,明確了自甘風(fēng)險(xiǎn)在競(jìng)技體育領(lǐng)域、自助游領(lǐng)域和交通領(lǐng)域的適用。
[Abstract]:Although our country does not stipulate the self-indulgence risk in the law, it already has the application to the self-indulgence risk in the judicial practice. In order to make the application of this kind of cases no longer confused, it is necessary to clearly stipulate the risk of self-indulgence in the law. Starting from the real cases, this paper selects 38 cases, compares and analyzes the applicable positive and negative jurisprudence, sums up the fields and conditions of the application of Zigan risk, and clarifies the self-Gump risk in the field of competitive sports. The application of the field of self-service travel and the field of transportation.
