大學生專利成果轉化的制度完善與平臺構建

【摘要】：隨著經濟全球化浪潮的席卷和知識經濟時代的到來,知識產權已經成為國家發(fā)展的核心資源和考量國際競爭力的重要標準。2008年,我國發(fā)布了《國家知識產權戰(zhàn)略綱要》,這標志著知識產權戰(zhàn)略作為我國重要的國家戰(zhàn)略正式開始全面實施。2012年底,黨的“十八大”明確提出,科技創(chuàng)新是提高社會生產力和綜合國力的戰(zhàn)略支撐,必須擺在國家發(fā)展全局的核心位置,強調要堅持走中國特色自主創(chuàng)新道路,實施創(chuàng)新驅動發(fā)展戰(zhàn)略。在知識經濟成為21世紀主導經濟形態(tài)的形勢下,作為在知識經濟時代趕超發(fā)達國家的重要戰(zhàn)略舉措,我國提出了建立國家創(chuàng)新體系的戰(zhàn)略。而創(chuàng)新的關鍵在于人才,未來人才的重點在于大學生�？梢�,本研究對于創(chuàng)新型國家的建設和知識產權戰(zhàn)略的實施具有重要的指導意義;對于提高大學生專利轉化能力和水平的制度建議與平臺構建具有重要的現實價值。本研究首先運用文獻研究法,對與大學生專利成果轉化相關的文獻資料進行了全面收集、研讀、分析和綜述;其次,通過對武漢市部分大學生專利成果轉化案例的實證分析,用訪談法進行了案例分析,再運用統(tǒng)計分析法、比較法對大學生專利成果轉化的基本現狀進行闡釋,解析出我國大學生專利成果轉化存在的瓶頸;最后運用分析歸納法、統(tǒng)計分析法和實證研究法對我國大學生專利成果轉化所需的法律機制、配套政策、教育體制和市場體制進行了專門研究,并綜合上述制度構建了大學生專利成果轉化的“3+X”平臺。本研究的創(chuàng)新點在于提煉出了我國大學生專利成果轉化所面臨的制度缺位、市場不完備、技術不成熟等瓶頸;以正在進行修訂的《促進科技成果轉化法》為依托,從法律、政策、高校培育制度、市場制度四個方面對我國大學生專利成果轉化進行了制度構建;構建了大學生專利成果轉化的“3+X”多維度平臺。
[Abstract]:With the wave of economic globalization and the arrival of the era of knowledge-based economy, intellectual property rights have become the core resources for national development and important standards for consideration of international competitiveness. In 2008, China issued the outline of National intellectual property Strategy. This marks the beginning of the full implementation of the intellectual property strategy as an important national strategy in China. At the end of 2012, the 18th National Congress of the Communist Party of China explicitly proposed that scientific and technological innovation is the strategic support for improving social productivity and comprehensive national strength. We must put it at the core of the overall situation of national development, emphasize that we should adhere to the path of independent innovation with Chinese characteristics and implement the innovation-driven development strategy. Under the situation that the knowledge economy has become the dominant economic form in the 21st century, as an important strategic measure to catch up with and surpass the developed countries in the era of knowledge economy, our country has put forward the strategy of establishing the national innovation system. The key to innovation lies in talent, and the focus of talent in the future lies in college students. It can be seen that this study has an important guiding significance for the construction of an innovative country and the implementation of intellectual property strategy, and has important practical value for improving university students' patent conversion ability and level of institutional recommendations and platform construction. Firstly, using the method of literature research, the author collects, reads, analyzes and summarizes the documents related to the transformation of university students' patent achievements in an all-round way. Secondly, through the empirical analysis of the transformation cases of some university students' patent achievements in Wuhan, this paper carries on the case analysis with the interview method, and then uses the statistical analysis method and the comparative method to explain the basic status quo of the transformation of the university students' patent achievements. Analyzing the bottleneck existing in the transformation of the patent achievements of college students in our country; Finally, the author makes a special study on the legal mechanism, supporting policies, education system and market system required for the transformation of university students' patent achievements by means of analytical induction method, statistical analysis method and empirical research method. And comprehensive above-mentioned system has constructed the university student patent achievement transformation "3X" platform. The innovation of this research lies in refining the bottleneck of the transformation of patent achievements of college students in China, such as lack of system, incomplete market, immature technology and so on. Based on the Law on promoting the Transformation of Scientific and technological achievements which is being revised, this paper constructs the system of the transformation of patent achievements of college students in China from four aspects: law, policy, cultivation system of colleges and universities, and market system. The "3 X" multi-dimensional platform for the transformation of university students' patent achievements has been constructed.
