【摘要】：民法典總則編規(guī)定法律適用規(guī)則,是1804年《法國(guó)民法典》創(chuàng)設(shè)的立法例,200多年來(lái)被絕大多數(shù)國(guó)家所借鑒,成為大多數(shù)民法典的立法通例。20世紀(jì)初葉,我國(guó)清末西法東漸,變律為法,制定《大清民律草案》時(shí),依照我國(guó)古代立法習(xí)慣,創(chuàng)設(shè)了法例制度,用以概括民法適用規(guī)則,并被民國(guó)民法所確立。1949年之后,我國(guó)的民法草案及《民法通則》都沒有規(guī)定法例規(guī)則,民法適用方法欠缺,導(dǎo)致民事司法不統(tǒng)一。制定我國(guó)民法典總則編,應(yīng)當(dāng)堅(jiān)持規(guī)定具有中國(guó)特色的法例制度,明確民法的一般適用方法,對(duì)于統(tǒng)一我國(guó)民事法律規(guī)范的適用,將會(huì)起到重大作用。
[Abstract]:The General provisions of the Civil Code prescribe the applicable rules of law, which is a legislative example created by the French Civil Code in 1804, which has been used for reference by the vast majority of countries for more than 200 years, and has become a general legislative example of most civil codes. At the beginning of the 20th century, the western law in late Qing Dynasty and the eastern part of our country became more and more popular. When changing the law into law and drawing up the draft Civil Law of the Qing Dynasty, in accordance with the ancient legislative habits of our country, a legal system was created to summarize the applicable rules of the civil law, which was established by the civil law of the Republic of China after 1949. Neither the draft civil law nor the General principles of Civil Law in our country prescribe the rules of the law. The lack of applicable methods of the civil law leads to the inconsistency of the civil justice. In formulating the General provisions of the Civil Code of China, we should insist on stipulating the legal system with Chinese characteristics and clarify the general applicable methods of the civil law, which will play an important role in unifying the application of the civil legal norms in our country.
