【摘要】：初級農(nóng)產(chǎn)品是食品安全的基礎(chǔ)和源頭,只有從源頭著手,才能有效維護(hù)消費者的合法權(quán)益。傳統(tǒng)民法對初級農(nóng)產(chǎn)品侵權(quán)責(zé)任適用過錯責(zé)任原則的模式隨著社會發(fā)展已經(jīng)難以適應(yīng)現(xiàn)代社會的需求,無法有效平衡雙方當(dāng)事人的利益,不利于受害人的救濟(jì)。應(yīng)當(dāng)將初級農(nóng)產(chǎn)品侵權(quán)責(zé)任納入產(chǎn)品責(zé)任范圍,適用嚴(yán)格責(zé)任原則,以實現(xiàn)對受害人的充分救濟(jì)。
[Abstract]:Primary agricultural products are the basis and source of food safety, only from the source, can effectively safeguard the legitimate rights and interests of consumers. With the development of the society, the mode of applying the principle of fault liability to the tort liability of primary agricultural products in the traditional civil law has been difficult to adapt to the needs of the modern society, which can not effectively balance the interests of both parties and is not conducive to the relief of the victims. The tort liability of primary agricultural products should be brought into the scope of product liability and the principle of strict liability should be applied in order to realize the full relief to the victims.
