【摘要】：專利法第三十三規(guī)定了申請人可以對申請文件進(jìn)行修改,但同時(shí)也規(guī)定了其修改不能超出原始申請文件記載的范圍。然而,在審查實(shí)踐中,判斷修改是否超范圍往往存在不一致的觀點(diǎn)。本文首先簡要介紹了各國關(guān)于申請文件修改的原則,接著通過對兩個(gè)具體案例的分析,闡述了在實(shí)質(zhì)審查過程中應(yīng)當(dāng)如何把握修改超范圍的審查尺度,以期審查實(shí)踐中標(biāo)準(zhǔn)執(zhí)行一致。
[Abstract]:Patent Law No. 33 provides that the applicant may modify the application document, but also stipulates that the amendment shall not exceed the scope of the original application document. However, in the review practice, there are often inconsistent views in judging whether the modification is beyond the scope. This paper first briefly introduces the principles of the amendment of application documents in various countries, and then through the analysis of two specific cases, expounds how to grasp the scope of the review of the amendment in the process of substantive review.
