【摘要】：擬定中的民法典物權(quán)編的編制體例應與《民法總則》相協(xié)調(diào),現(xiàn)行《物權(quán)法》中的"編"應降級為"章"、"章"降級為"節(jié)"。物權(quán)編的第一章宜更名為"通則",第二章的內(nèi)容應并入第一章;第三章的內(nèi)容除關(guān)于物權(quán)請求權(quán)的規(guī)定宜調(diào)整到通則部分外,其余規(guī)定應予刪除。所有權(quán)部分除應完善建筑物區(qū)分所有權(quán)、共有、相鄰關(guān)系的規(guī)則外,重點應在所有權(quán)取得的特別規(guī)定中補充先占、添附、動產(chǎn)取得時效、貨幣與有價證券所有權(quán)的得喪規(guī)則等。用益物權(quán)部分除適當修改農(nóng)業(yè)用地承包經(jīng)營權(quán)等的規(guī)則外,應重點增補居住權(quán)、海域使用權(quán)、典權(quán)等用益物權(quán)類型;擔保物權(quán)部分應完善擔保的一般規(guī)則,增加擔保財產(chǎn)的范圍,對流質(zhì)條款的效力有限開禁;占有部分應增加關(guān)于占有的種類、占有的狀態(tài)推定和權(quán)利推定等規(guī)則,提高對善意占有人利益保護的力度。
[Abstract]:The drafting style of the current civil code should be coordinated with the General principles of Civil Law. In the present Real right Law, the "compilation" should be reduced to "Chapter" and the "Chapter" should be downgraded to "Section". The first chapter of the title of real right should be renamed as "general rule", the content of chapter II should be incorporated into chapter 1, and the content of chapter III should be deleted except for the provisions on the right of claim in real right to be adjusted to the part of general rules. In addition to perfecting the rules of building ownership, common ownership and adjacent relations, the part of ownership should be supplemented with preemption, attachment, limitation of acquisition of movable property, loss rules of ownership of money and marketable securities and so on. The usufruct part, in addition to the appropriate modification of the rules of the right to contract management of agricultural land, should focus on adding the types of usufruct, such as the right of residence, the right to use the sea area, and the right to pawn. The part of security interest should perfect the general rules of security, increase the scope of secured property, and ban the validity of liquid clause; In order to protect bona fide possessor's interests, some rules should be added, such as types of possession, presumption of state of possession and presumption of right.
