【摘要】：大學(xué)校園學(xué)術(shù)性騷擾事件頻發(fā)引起了社會(huì)普遍關(guān)注,但普通公眾及學(xué)術(shù)界對(duì)此卻存在較大認(rèn)知差異,各類(lèi)話語(yǔ)大都從道德審判角度來(lái)探討問(wèn)題,從加強(qiáng)師德建設(shè)的思路提出解決方案。本研究認(rèn)為,要想有效防治校園學(xué)術(shù)性騷擾的發(fā)生,絕不只是關(guān)乎道德倫理,它更需要法律的介入和制度的約束。在高校推進(jìn)法治化的進(jìn)程中,規(guī)范師生間的權(quán)利義務(wù)關(guān)系,走出"自由論"的思維困境,將學(xué)術(shù)性騷擾關(guān)注焦點(diǎn)由個(gè)人意愿、道德審判轉(zhuǎn)向?qū)Ω咝Ｏ嚓P(guān)體制、規(guī)章制度的建構(gòu)與改善,并納入女性權(quán)益和性別平等的概念框架,從而建立起針對(duì)學(xué)術(shù)性騷擾有效的預(yù)防和干預(yù)機(jī)制。
[Abstract]:The frequent occurrence of academic sexual harassment on university campuses has aroused widespread concern in the society, but there are great differences in cognition between the general public and the academic community, and most of the discourses are discussed from the point of view of moral judgment. This paper puts forward the solution from the train of thought of strengthening the construction of teachers' ethics. This study believes that to effectively prevent and control the occurrence of academic sexual harassment on campus, it is not only about moral ethics, but also needs the intervention of law and the restriction of system. In the process of promoting the rule of law in colleges and universities, we should standardize the relationship between teachers and students' rights and obligations, walk out of the thinking dilemma of "freedom theory", and turn the focus of academic sexual harassment from individual will to moral trial to the related system of colleges and universities. The construction and improvement of the rules and regulations, and the incorporation of the conceptual framework of women's rights and gender equality, so as to establish an effective prevention and intervention mechanism against academic sexual harassment.
