社交平臺交易下的消費者權(quán)益保護(hù)

【摘要】:隨著各種社交軟件的應(yīng)用和發(fā)展,有很多人在社交平臺上做起了買賣交易。這種社交平臺交易作為新型的購物模式,以其便捷和實惠的優(yōu)勢,迅速受到大眾的喜愛。本文主要圍繞個人與個人在社交平臺上進(jìn)行交易的模式,在區(qū)分社交平臺與網(wǎng)絡(luò)交易平臺性質(zhì)不同的基礎(chǔ)上,進(jìn)一步分析社交平臺交易中買賣雙方的法律地位。這種社交平臺購物模式雖然給消費者帶來了很大的便利,但是卻使得在保護(hù)消費者權(quán)益方面產(chǎn)生了新的法律問題和困擾。社交平臺交易不同于傳統(tǒng)的網(wǎng)絡(luò)交易平臺,其經(jīng)營者無須進(jìn)行實名登記,在發(fā)布產(chǎn)品廣告方面也沒有限制,買賣雙方一般基于信任完成交易。因無法獲知經(jīng)營者的真實信息,且法律對社交平臺交易尚無相關(guān)規(guī)定,消費者在發(fā)生交易糾紛時往往很難維權(quán)。本文以社交平臺交易下的消費者權(quán)益保護(hù)為研究對象,首先論述社交平臺交易與相關(guān)的法律問題,理清社交平臺與第三方交易平臺的區(qū)別;其次,對我國社交平臺交易下的消費者權(quán)益保護(hù)現(xiàn)狀進(jìn)行分析;再次,借鑒國外對社交平臺交易的規(guī)制做法并提出對我國的啟示;最后,針對社交平臺交易存在的問題提出相應(yīng)的對策和建議,旨在更好地保護(hù)社交平臺交易下的消費者權(quán)益。論文主要內(nèi)容分為四個部分:第一部分,首先介紹了社交平臺交易的概念和特征,分析社交平臺與第三方交易平臺的區(qū)別,以及社交平臺交易下買賣雙方主體的法律地位;第二部分,論述社交平臺交易下消費者權(quán)益保護(hù)現(xiàn)狀,包括立法現(xiàn)狀和司法現(xiàn)狀,并對現(xiàn)狀存在問題的原因進(jìn)行分析。第三部分,分析論述國外對社交平臺交易的規(guī)制,借鑒并提出對我國的幾點啟示;第四部分,針對社交平臺交易下消費者權(quán)益保護(hù)存在的問題,提出對策和建議,主要包括構(gòu)建完善的法律制度,建立第三方社交平臺準(zhǔn)入體系和監(jiān)督體系等。
[Abstract]:With the application and development of various social software, many people start trading on social platform. As a new type of shopping mode, this kind of social platform trading is quickly popular with its convenient and affordable advantages. This paper focuses on the mode of transaction between individuals and individuals on social platform. On the basis of distinguishing the nature of social platform and online trading platform, this paper further analyzes the legal status of the seller and buyer in the transaction of social platform. Although this kind of social platform shopping mode has brought great convenience to consumers, it has caused new legal problems and puzzles in protecting consumers' rights and interests. Social platform trading is different from the traditional online trading platform, its operators do not need to register their real names, and there are no restrictions on the advertising of products. The buyers and sellers usually complete transactions based on trust. Because of the lack of real information about the operators and the absence of legal rules on social platform transactions, consumers often find it difficult to defend their rights in the event of a transaction dispute. This paper takes the protection of consumers' rights and interests under the social platform transaction as the research object, first discusses the social platform transaction and the related legal problems, clarifies the difference between the social platform and the third party trading platform; Secondly, it analyzes the current situation of the protection of consumers' rights and interests under the transaction of social platform in our country; thirdly, draws lessons from the foreign regulation of the transaction of social platform and puts forward the enlightenment to our country; Finally, some countermeasures and suggestions are put forward to better protect the consumers' rights and interests in social platform transactions. The main content of this paper is divided into four parts: the first part introduces the concept and characteristics of social platform trading, analyzes the difference between social platform and third party trading platform, and the legal status of the main body of the buyer and seller under the social platform transaction; The second part discusses the current situation of consumer rights and interests protection under social platform trading, including legislative and judicial status, and analyzes the reasons for the existing problems. The third part, analyzes and discusses the foreign regulation of social platform transactions, and puts forward some enlightenment to our country. In the fourth part, in view of the problems in the protection of consumers' rights and interests under the transaction of social platform, the author puts forward the countermeasures and suggestions, mainly including the construction of a perfect legal system, the establishment of a third party social platform access system and supervision system, and so on.
