【摘要】：隨著我國知識經(jīng)濟的蓬勃發(fā)展,以知識產(chǎn)權(quán)為靈魂的高新企業(yè)迅速崛起,逐漸成為推動我國知識產(chǎn)權(quán)經(jīng)濟持續(xù)發(fā)展和快速進步的主導(dǎo)性力量。然近年來,我國高新企業(yè)在知識產(chǎn)權(quán)領(lǐng)域的法律風(fēng)險頻發(fā),使企業(yè)面臨越來越多的法律訴訟,損害其知識產(chǎn)權(quán)資源的運營能力,進而阻礙企業(yè)的全局發(fā)展。因此,本文立足于我國高新企業(yè)特點之上,剖析其在應(yīng)對知識產(chǎn)權(quán)法律風(fēng)險中存在的知識產(chǎn)權(quán)戰(zhàn)略規(guī)劃欠缺、法律風(fēng)險認識錯誤、法律風(fēng)險管理機制落后和管理投入不足等問題。解決上述問題的第一步是科學(xué)地識別出知識產(chǎn)權(quán)實務(wù)中,對高新企業(yè)發(fā)展有較大影響的法律風(fēng)險類型,使得高新企業(yè)管理者對這些風(fēng)險有直觀的認識和深入的了解。進而,能夠在識別和分析的基礎(chǔ)上構(gòu)建科學(xué)而高效的知識產(chǎn)權(quán)法律風(fēng)險防控體系。這一體系不僅僅要求企業(yè)自身在正確的知識產(chǎn)權(quán)法律風(fēng)險防范意識的指導(dǎo)下,構(gòu)建以知識產(chǎn)權(quán)戰(zhàn)略為核心,以總法律顧問為舵手的集中管理制度,更需要外部立法和政策的扶持和配合,為高新企業(yè)營造良好的法治環(huán)境和社會環(huán)境。通過這些措施可以從源頭起最大限度地避免知識產(chǎn)權(quán)法律風(fēng)險向危機的轉(zhuǎn)化,進一步促進企業(yè)的蓬勃發(fā)展。
[Abstract]:With the vigorous development of knowledge economy in China, high-tech enterprises with intellectual property rights as their soul have risen rapidly, and have gradually become the leading force to promote the sustained development and rapid progress of intellectual property economy in China. However, in recent years, the frequent legal risks of high-tech enterprises in the field of intellectual property rights make enterprises face more and more legal litigation, damage the operation ability of intellectual property resources, and then hinder the overall development of enterprises. Therefore, based on the characteristics of high-tech enterprises in our country, this paper analyzes the lack of strategic planning of intellectual property rights in dealing with the legal risks of intellectual property, and wrong understanding of legal risks. The legal risk management mechanism is backward and the management investment is insufficient and so on. The first step to solve the above problems is to scientifically identify the types of legal risks that have great influence on the development of high-tech enterprises in the practice of intellectual property rights, so that the managers of high-tech enterprises have a direct understanding and in-depth understanding of these risks. On the basis of identification and analysis, a scientific and efficient intellectual property legal risk prevention and control system can be constructed. This system not only requires enterprises to set up a centralized management system with intellectual property strategy as the core and general counsel as the helmsman under the guidance of correct awareness of intellectual property legal risk prevention. It also needs the support and cooperation of external legislation and policies to create a good environment of rule of law and social environment for high-tech enterprises. Through these measures, we can avoid the transformation of intellectual property legal risk to crisis as far as possible from the source, and further promote the vigorous development of enterprises.
