【摘要】：現(xiàn)實中越來越多的劇本、音樂作品委托創(chuàng)作合同中受托人為單位而非自然人,但實際創(chuàng)作作品的人只可能是自然人,實際上此種委托創(chuàng)作合同必然牽涉到受托單位與指定創(chuàng)作作品的自然人之間的法律關(guān)系。本文認為,作為劇本及音樂作品的委托創(chuàng)作合同的委托方,應(yīng)特別注意合同的受托方主體資格并采取適當(dāng)?shù)拇胧┮员ＷC委托創(chuàng)作合同的有效實施。
[Abstract]:In reality, more and more scripts are written. In the contract of entrusting the creation of music works, the trustee is the unit rather than the natural person, but the person who actually creates the work can only be a natural person. In fact, the commissioned creation contract must involve the legal relationship between the trustee and the designated natural person. This paper holds that as the principal party to the contract of commissioned creation of the script and music works, special attention should be paid to the subject qualification of the trustee of the contract and appropriate measures should be taken to ensure the effective implementation of the commissioned creation contract.
