【摘要】：隨著云計(jì)算技術(shù)的不斷發(fā)展,服務(wù)器逐步向云端擴(kuò)展,企業(yè)的互聯(lián)網(wǎng)接入服務(wù)從自建服務(wù)器、租賃服務(wù)器更多地轉(zhuǎn)向虛擬服務(wù)器、云服務(wù)器。服務(wù)器軟件著作權(quán)侵權(quán)的責(zé)任界分,面臨著司法實(shí)踐與審判理論的雙重難題。對(duì)服務(wù)器軟件不同類型侵權(quán)行為的歸責(zé),需要對(duì)"商業(yè)使用"及"過錯(cuò)要件"予以明確。從文義解釋、歷史解讀、學(xué)理解析的三個(gè)維度分析,商業(yè)使用是指包含"復(fù)制""發(fā)行"等行為的使用,本質(zhì)上指向復(fù)制、發(fā)行等侵權(quán)行為。而服務(wù)器軟件侵權(quán)應(yīng)依不同主體對(duì)服務(wù)器的控制力與對(duì)服務(wù)器軟件的識(shí)別力,合理分配其注意義務(wù),并以過錯(cuò)責(zé)任為原則,無過錯(cuò)責(zé)任為補(bǔ)充,針對(duì)不同侵權(quán)行為科以不同的責(zé)任方式。
[Abstract]:With the continuous development of cloud computing technology, the servers gradually expand to the cloud, the Internet access services of enterprises from self-built servers, rental servers to virtual servers, cloud servers. The infringement of server software copyright is faced with the dual problems of judicial practice and trial theory. For the different types of infringing actions of server software, it is necessary to clarify the "commercial use" and "fault elements". From the three dimensions of interpretation of literary meaning, historical interpretation and theoretical analysis, commercial use refers to the use of behaviors including "copy" and "issue", which in essence point to the infringement of reproduction and distribution. However, the infringement of server software should be based on the control power of different subjects to the server and the recognition of server software, and the duty of care should be reasonably assigned, and the principle of fault liability should be taken as the principle, and no fault liability should be added. According to the different tort division with different liability.
