【摘要】：由于我國(guó)現(xiàn)行欠缺民事行為能力成年人代位監(jiān)護(hù)制度設(shè)計(jì)中存在的一些問(wèn)題,導(dǎo)致欠缺民事行為能力成年人的監(jiān)護(hù)狀況并未達(dá)到立法的預(yù)期,完善代位監(jiān)護(hù)制度立法十分必要。本文以欠缺民事行為能力成年人代位監(jiān)護(hù)制度的補(bǔ)充性原則、責(zé)任分擔(dān)原則、尊重自主決定權(quán)原則和最佳利益原則等基本原則為出發(fā)點(diǎn),借鑒域外監(jiān)護(hù)立法改革的實(shí)踐經(jīng)驗(yàn),對(duì)代位監(jiān)護(hù)制度的啟動(dòng)條件、監(jiān)護(hù)主體、監(jiān)護(hù)形式等問(wèn)題進(jìn)行了較為深入地探討并提出完善建議。
[Abstract]:Due to some problems existing in the design of subrogation guardianship system for adults lacking civil capacity for conduct in our country, it is necessary to perfect the legislation of subrogation guardianship system due to the fact that the guardianship status of adults lacking civil capacity has not reached the expectation of legislation. Based on the basic principles of the subrogation guardianship system of adults lacking civil capacity, the principle of shared responsibility, the principle of respecting the autonomy and the principle of best interests, this paper draws lessons from the practical experience of the reform of extraterritorial guardianship legislation. The starting conditions, the subject and the form of subrogation are discussed and some suggestions are put forward.
