【摘要】：目前,在許多醫(yī)療機構(gòu)對藥品銷售實施"零加成"的模式下,由缺陷藥品引起的醫(yī)療損害賠償方式若仍按照一般缺陷產(chǎn)品的追責方式由醫(yī)療機構(gòu)承擔無過錯責任無疑加重了醫(yī)療機構(gòu)的賠償責任,甚至有違權利與義務對等的基本原則。近年,有關藥品銷售"零加成"模式下應弱化醫(yī)療機構(gòu)對缺陷藥品賠償責任的呼吁雖有不少,但由于作為受到缺陷藥品損害且相對"弱勢"的患者一方必須在第一時間獲得賠償也畢竟是天經(jīng)地義之事�？赏ㄟ^建立藥品責任強制性保險、設立藥品損害風險保障基金等改變現(xiàn)有缺陷藥品損害責任的追責模式,進而弱化醫(yī)療機構(gòu)對缺陷藥品的賠償責任。
[Abstract]:At present, under the model of "zero addition" for drug sales in many medical institutions, If the mode of medical damage compensation caused by defective drugs is still in accordance with the general liability of defective products, the non-fault liability of medical institutions will undoubtedly increase the liability of medical institutions, and even violate the basic principle of equal rights and obligations. In recent years, although there have been many calls for weakening the liability of medical institutions to compensate for defective drugs under the "zero plus" model of drug sales, But as a victim of defective drugs and a relatively "vulnerable" party must receive compensation in the first place, after all, it is natural. By establishing compulsory insurance for drug liability and establishing drug damage risk protection fund, the existing liability model of defective drug damage liability can be changed, and the liability of medical institutions for defective drugs can be weakened.
