【摘要】：添附是指通過結(jié)合使得歸屬于不同所有人的物重新形成不可分離的物或具有新性質(zhì)的物,包括加工,混合和附合,添附制度是各國物權(quán)法中公認(rèn)的一種確權(quán)手段,也是一個(gè)重要的物權(quán)變動(dòng)方式。添附制度作為一項(xiàng)獨(dú)立的物權(quán)制度,其獨(dú)立價(jià)值不能為侵權(quán)請求權(quán)、物權(quán)請求權(quán),不當(dāng)?shù)美颠�請求權(quán)制度取而代之。獨(dú)立健全的添附制度的確立在我國《物權(quán)法》的制訂過程中有著不可忽視的重要地位。
[Abstract]:Additionality means that by combining things that belong to different owners to form inseparable objects or things of new nature, including processing, mixing and attachment, the system of attachment is recognized as a means of confirming the right of rights in various countries' property law. It is also an important way to change real right. As an independent real right system, its independent value can not be replaced by tort claim, real right claim and unjust enrichment return claim system. The establishment of independent and sound attachment system plays an important role in the formulation of Real right Law in China.
