【摘要】：住宅建設(shè)用地使用權(quán)自動(dòng)續(xù)期的規(guī)制目標(biāo)是清楚的,而對(duì)于何種規(guī)制方案能夠?qū)崿F(xiàn)上述目標(biāo)則眾說紛紜。自動(dòng)續(xù)期問題的實(shí)質(zhì)是如何實(shí)現(xiàn)土地資源的公平分配。一概無償自動(dòng)續(xù)期以及"一次獲得,永久使用"等方案看似合理,實(shí)則有違市場(chǎng)邏輯,對(duì)既有的居住建設(shè)用地使用權(quán)人并不公平,且會(huì)誘發(fā)地方政府的策略行為或投機(jī)行為。而采用市場(chǎng)方式進(jìn)行個(gè)別化談判和靈活期限續(xù)期以及試錯(cuò)的做法同樣會(huì)產(chǎn)生極高的交易成本,并產(chǎn)生不公平的結(jié)果和系統(tǒng)性風(fēng)險(xiǎn)。這些都可能破壞自動(dòng)續(xù)期規(guī)制目標(biāo)的實(shí)現(xiàn)。自動(dòng)續(xù)期制度設(shè)計(jì)必須以公平等法律價(jià)值為基點(diǎn)并在效果上接受其檢驗(yàn)。
[Abstract]:The regulation target of the automatic renewal of the right to use residential construction land is clear, but there are different opinions about which regulatory scheme can achieve the above goal. The essence of automatic renewal is how to realize the equitable distribution of land resources. Such schemes as automatic renewal without compensation and "once acquired, permanent use" seem reasonable, but they are contrary to the logic of the market, are unfair to the existing users of residential and construction land use rights, and will induce the local government's strategic behavior or speculative behavior. Market approach to individualized negotiations and flexible renewal of deadlines, as well as trial and error practices, will also have extremely high transaction costs, and generate unfair results and systemic risks. All these may undermine the realization of the goal of automatic renewal regulation. The design of automatic renewal system must be based on the legal value of equity and be tested in effect.
