【摘要】：文化建設(shè)一直國家軟實力建設(shè)的重中之重,隨著經(jīng)濟全球化的發(fā)展,境內(nèi)外影視作品的版權(quán)貿(mào)易正呈現(xiàn)繁榮之勢。同時,網(wǎng)絡(luò)技術(shù)發(fā)展和信息時代的變遷為境外影視作品在我國境內(nèi)的傳播提供了便利。近年來,我國積極推行“互聯(lián)網(wǎng)+”行動計劃,認為互聯(lián)網(wǎng)是推動科技進步、創(chuàng)新驅(qū)動和文化繁榮的引擎動力。在這種互聯(lián)網(wǎng)創(chuàng)新驅(qū)動下,影視作品獲取了更多新型的傳播渠道,以此同時,網(wǎng)絡(luò)環(huán)境下境外影視作品著作權(quán)的保護也遭遇了前所未有的新問題、新挑戰(zhàn)。2014年1月,國家新聞出版廣電總局發(fā)布了《關(guān)于進一步完善網(wǎng)絡(luò)劇、微電影等網(wǎng)絡(luò)視聽節(jié)目管理的補充通知》,同年9月再次發(fā)布《進一步落實網(wǎng)上境外影視劇管理有關(guān)規(guī)定的通知》,對網(wǎng)絡(luò)環(huán)境下境外影視作品的著作權(quán)保護給予高度關(guān)注。通知旨在進一步完善網(wǎng)絡(luò)著作權(quán)的管理制度,營造文明健康的網(wǎng)絡(luò)環(huán)境,打擊網(wǎng)絡(luò)環(huán)境下境外影視作品著作權(quán)的侵權(quán)行為。通知還進一步明確對境外影視作品的網(wǎng)上傳播權(quán)實行行政審批制度,播放網(wǎng)站須于引進計劃的上一年度進行影片引進申報工作,并必須在網(wǎng)上境外影視劇引進信息統(tǒng)一登記平臺進行信息登記。由于這種“先審后播”的行政審批制度,網(wǎng)絡(luò)環(huán)境下境外影視作品的網(wǎng)絡(luò)傳播權(quán)受到限制,各種形式的著作權(quán)侵權(quán)行為屢屢發(fā)生。本文立足我國網(wǎng)絡(luò)環(huán)境下境外影視作品著作權(quán)侵權(quán)現(xiàn)狀,結(jié)合具體案例闡述了當前網(wǎng)絡(luò)環(huán)境中的侵權(quán)類型和主要問題,分析了我國網(wǎng)絡(luò)環(huán)境下境外影視作品保護制度的缺陷和不足,從而提出網(wǎng)上境外影視作品保護的具體對策。本論文共分為四部分,對網(wǎng)絡(luò)環(huán)境下境外影視作品的著作權(quán)保護進行研究探討：第一部分從法律層面對境外影視作品的概念、分類進行闡述,界定了網(wǎng)絡(luò)環(huán)境的概念和范疇,并分析了網(wǎng)絡(luò)環(huán)境下境外影視作品著作權(quán)的產(chǎn)生和權(quán)利歸屬問題。第二部分以具體案例為基礎(chǔ),對當前網(wǎng)上境外影視作品的侵權(quán)類型進行梳理,主要分析了視頻網(wǎng)站、聚合類APP和自媒體三種類型的侵權(quán)方式和侵權(quán)責任。第三部分主要論述了我國網(wǎng)絡(luò)環(huán)境下境外影視作品著作權(quán)的保護現(xiàn)狀,首先分析了進口影視作品的行政審批制度及其缺陷,其次分析了《著作權(quán)法》第四條和法院具體判定標準方面的問題與不足,進一步對未經(jīng)審批境外影視作品的著作權(quán)保護做出探討。第四部針對網(wǎng)絡(luò)環(huán)境下境外影視作品侵權(quán)的具體問題,主要從網(wǎng)絡(luò)環(huán)境下境外影視作品行政審批制度的改革、網(wǎng)絡(luò)環(huán)境下境外影視作品侵權(quán)法律規(guī)制的完善、境外影視作品損害賠償和臨時性保護措施的構(gòu)建幾個方面提出切實可行的建議,為我國網(wǎng)絡(luò)環(huán)境下境外影視作品保護體系的發(fā)展建言獻策。
[Abstract]:With the development of economic globalization, the copyright trade of domestic and foreign film and television works is showing a prosperous trend. At the same time, the development of network technology and the change of information age provide convenience for the spread of foreign film and television works in our country. In recent years, China has actively carried out the "Internet" action plan, which holds that the Internet is the engine driving scientific and technological progress, innovation driving and cultural prosperity. Driven by this kind of Internet innovation, film and television works have acquired more new channels of communication, and at the same time, the protection of copyright in foreign film and television works under the network environment has also encountered unprecedented new problems and challenges. In January 2014, The State Administration of Press, publication, Radio, Film and Television issued a supplementary notice on the further improvement of the management of online audiovisual programs such as network plays, microfilms, and so on. Pay close attention to the copyright protection of foreign film and television works under the network environment. The notice aims to further improve the network copyright management system, create a civilized and healthy network environment, and crack down on copyright infringement of foreign film and television works under the network environment. The circular also further clarifies the implementation of the administrative examination and approval system for the online transmission right of foreign film and television works, and the broadcasting website must carry out the application work for the introduction of films in the previous year of the introduction plan. And must introduce the information unified registration platform to carry on the information registration in the network overseas movie and television drama. As a result of the administrative examination and approval system of "first trial and then broadcast", the network communication right of foreign film and television works is restricted under the network environment, and various forms of copyright infringement occur frequently. Based on the current situation of copyright infringement of foreign film and television works under the network environment of our country, this paper expounds the types and main problems of the infringement in the current network environment in combination with specific cases. This paper analyzes the defects and shortcomings of the protection system of foreign film and television works under the network environment of our country, and puts forward the concrete countermeasures for the protection of overseas film and television works on the net. This paper is divided into four parts, the copyright protection of foreign film and television works under the network environment is studied. The first part expounds the concept and classification of foreign film and television works from the legal level, and defines the concept and category of the network environment. It also analyzes the emergence and ownership of copyright in foreign film and television works under the network environment. The second part is based on specific cases to sort out the current online foreign film and television works infringement types, mainly analyzes the video site, aggregate APP and self-media three types of tort and tort liability. The third part mainly discusses the current situation of copyright protection of foreign film and television works under the network environment of our country. Firstly, it analyzes the administrative examination and approval system of imported film and television works and its defects. Secondly, it analyzes the problems and shortcomings of the fourth article of the copyright Law and the specific judgment standard of the court, and further probes into the copyright protection of foreign film and television works without examination and approval. The fourth part aims at the specific problems of foreign film and television works infringement under the network environment, mainly from the reform of the administrative examination and approval system of the overseas film and television works under the network environment, and the perfection of the legal regulation of the foreign film and television works infringement under the network environment. This paper puts forward some practical suggestions on the construction of damages and temporary protection measures for foreign film and television works in order to provide suggestions for the development of the protection system of foreign film and television works under the network environment of our country.
