【摘要】：異議登記是否具有限制權(quán)利人處分登記財(cái)產(chǎn)的效力,應(yīng)結(jié)合文義、體系和比較法等多種解釋方法予以把握。我國法律特設(shè)異議登記效力期間制度,較好地平衡了當(dāng)事人之間的權(quán)利和義務(wù),在此之下,采取不限制處分的立法模式具有更高的制度效率,不動(dòng)產(chǎn)統(tǒng)一登記條例應(yīng)予采納。異議登記效力期間制度也影響異議登記注銷模式的選擇,我國法律應(yīng)允許登記機(jī)關(guān)在異議登記效力期間屆滿失效后依職權(quán)注銷異議登記。
[Abstract]:Whether the objection registration has the effect of restricting the right holder to dispose of the registered property should be grasped by combining with various interpretation methods, such as text meaning, system and comparative law. The system of special objection registration period in our country has well balanced the rights and obligations between the parties. Under this system, it is more efficient to adopt the legislative mode of not limiting the disposition, and the uniform registration regulations of immovable property should be adopted. The system of validity period of dissenting registration also affects the choice of cancellation mode of dissent registration. Our law should allow the registration authority to cancel dissent registration ex officio after the expiration of the validity period of dissent registration.
