【摘要】：大數(shù)據(jù)作為國(guó)家基礎(chǔ)性戰(zhàn)略資源,在革新經(jīng)濟(jì)運(yùn)行機(jī)制和國(guó)家治理能力的同時(shí),也給我國(guó)的社會(huì)法制帶來(lái)了重要影響。由于我國(guó)相關(guān)法律法規(guī)建設(shè)滯后,公民的網(wǎng)絡(luò)隱私權(quán)在大數(shù)據(jù)時(shí)代受到嚴(yán)重威脅。因此,我國(guó)亟需推動(dòng)網(wǎng)上個(gè)人信息保護(hù)立法工作,加快網(wǎng)絡(luò)隱私權(quán)的立法和司法革新,注重互聯(lián)網(wǎng)技術(shù)與隱私權(quán)立法的結(jié)合,促進(jìn)大數(shù)據(jù)的合法利用。在立足中國(guó)國(guó)情的基礎(chǔ)上借鑒西方國(guó)家的相關(guān)制度,建立與大數(shù)據(jù)時(shí)代特色相適應(yīng)的法律體系。
[Abstract]:Big data, as the country's basic strategic resource, not only innovates the economic operation mechanism and the national governance ability, but also brings important influence to the social legal system of our country. Due to the lagging construction of relevant laws and regulations in China, citizens' right to network privacy was seriously threatened in big data's time. Therefore, it is urgent for our country to promote the legislation of personal information protection on the Internet, speed up the legislative and judicial innovation of the right to network privacy, pay attention to the combination of Internet technology and privacy legislation, and promote the lawful use of big data. Based on the national conditions of China, the relevant systems of western countries are used for reference, and the legal system adapted to big data's era is established.
