【摘要】：小區(qū)停車位相關(guān)爭議既是建筑物區(qū)分所有權(quán)下的物權(quán)法問題,又是關(guān)系到稀缺資源配置、信息披露和交易公平的社會經(jīng)濟(jì)問題,故解決該爭議的視角應(yīng)多樣化。所以,從幾個角度明確小區(qū)車位、車庫物權(quán)的法經(jīng)濟(jì)學(xué)理論基礎(chǔ),并從物權(quán)法的解釋論視角,論證以《物權(quán)法》第74條所確立的"二元分類"作為實(shí)踐中解決小區(qū)停車位權(quán)利歸屬基礎(chǔ)原則的合法性、正當(dāng)性和可行性。同時,信息公開應(yīng)作為保障業(yè)主權(quán)利的輔助性政策,以解決"二元分類"標(biāo)準(zhǔn)可能的負(fù)面效應(yīng)。
[Abstract]:The dispute about parking space in residential area is not only a property law problem under the ownership of building division, but also a social and economic problem related to the allocation of scarce resources, information disclosure and fair transaction. Therefore, the perspective of resolving this dispute should be diversified. Therefore, from several angles to clarify the legal and economic theoretical basis of parking spaces and garage real rights in residential areas, and from the angle of interpretation of property law, This paper demonstrates the legality, legitimacy and feasibility of solving the basic principle of the ownership of parking space rights in residential areas by "dual classification" established in Article 74 of the Real right Law. At the same time, the disclosure of information should be regarded as an auxiliary policy to protect the owner's rights in order to solve the possible negative effects of the dualistic classification standard.
