【摘要】：從應(yīng)然和實(shí)然角度,建立一套科學(xué)、高效、可操作性強(qiáng)的技術(shù)調(diào)查制度,對(duì)于提高我國現(xiàn)行專利確權(quán)和侵權(quán)處理機(jī)制的效益具有基礎(chǔ)性和長(zhǎng)遠(yuǎn)性的重要意義。通過對(duì)引入技術(shù)調(diào)查制度的必要性、國外專利技術(shù)調(diào)查制度的考察、我國專利確權(quán)和侵權(quán)技術(shù)調(diào)查制度的歷史演變等方面予以分析和論證,最后提出完善相關(guān)制度的建議,以期為健全我國技術(shù)調(diào)查制度提供一些建設(shè)性的意見和參考。
[Abstract]:From the point of view of necessity and reality, it is of fundamental and long-term significance to establish a set of scientific, efficient and operable technical investigation system for improving the efficiency of the current patent confirmation right and infringement treatment mechanism in China. Through the analysis and demonstration of the necessity of introducing technology investigation system, the investigation of foreign patent technology investigation system, the historical evolution of patent confirmation right and tort technology investigation system in our country, the paper puts forward some suggestions to perfect the relevant system. In order to improve our technical investigation system to provide some constructive advice and reference.
