貴陽市花溪區(qū)宅基地使用權(quán)流轉(zhuǎn)問題研究

【摘要】:一塊宅基地,其上附加的權(quán)利具有多樣性和多重性,包括集體土地所有權(quán)、宅基地所有權(quán)和使用權(quán)、農(nóng)民住房所有權(quán)、農(nóng)民居住權(quán)等,因不同的權(quán)利涉及不同的主體,所以農(nóng)村宅基地使用權(quán)流轉(zhuǎn)就會(huì)涉及到流轉(zhuǎn)利益在不同的主體之間的合理分配問題,又因?yàn)槲覈幱谄瞥青l(xiāng)二元結(jié)構(gòu)、加快實(shí)現(xiàn)城鎮(zhèn)化的歷史階段,所涉及的利益訴求更復(fù)雜和多元,更加劇了宅基地使用權(quán)改革和現(xiàn)代流轉(zhuǎn)制度構(gòu)建的困難性。本文通過對(duì)調(diào)查材料的分析研究,找出花溪區(qū)宅基地使用權(quán)流轉(zhuǎn)中最突出的問題并提出適當(dāng)?shù)慕鉀Q方法和建議,以期更加完善的花溪區(qū)宅基地使用權(quán)流轉(zhuǎn)制度的建立,為提高農(nóng)村土地利用率、增加農(nóng)民財(cái)產(chǎn)性收益提供制度保障。本文主要分為四部分。第一部分是緒論,主要就本文的研究背景及意義、研究現(xiàn)狀、宅基地使用權(quán)相關(guān)概念的理解進(jìn)行闡述。本文的研究處于我國破除城鄉(xiāng)二元結(jié)構(gòu)、深化農(nóng)村土地制度改革的大背景下,符合社會(huì)經(jīng)濟(jì)發(fā)展現(xiàn)狀,有利于提高花溪區(qū)農(nóng)村宅基地利用率、增加花溪區(qū)農(nóng)民財(cái)產(chǎn)性收益。對(duì)現(xiàn)行理論研究與法律政策的梳理加深了筆者對(duì)宅基地制度的認(rèn)知,為更好地完成論文提供了幫助。只有充分了解宅基地制度的歷史變遷過程,才能更好地理解我國宅基地使用權(quán)的內(nèi)涵和特征,本部分是本文能夠順利完成的前提。本文第二部分簡單闡述了調(diào)查的基本情況,通過對(duì)花溪區(qū)法院案卷的調(diào)閱、對(duì)花溪區(qū)部分村寨的問卷調(diào)查及對(duì)花溪區(qū)基層工作人員的訪談,掌握了關(guān)于花溪區(qū)宅基地使用權(quán)流轉(zhuǎn)情況的豐富材料,是完成本文的基礎(chǔ)。本文第三部分是本文的重點(diǎn)部分,該部分分別就花溪區(qū)宅基地使用權(quán)在初始流轉(zhuǎn)、再次流轉(zhuǎn)、糾紛解決中遇到的問題及相關(guān)建議進(jìn)行了詳細(xì)闡述。提倡初始取得的有償性,通過建設(shè)農(nóng)村公寓來改善宅基地不足的現(xiàn)狀,堅(jiān)持審慎、逐步、適度放開宅基地流轉(zhuǎn)的態(tài)度,加強(qiáng)對(duì)宅基地的管理,完善宅基地糾紛司法解決方法。本文第四部分是結(jié)語,就花溪區(qū)宅基地使用權(quán)流轉(zhuǎn)問題進(jìn)行總結(jié)。
[Abstract]:The rights attached to a homestead have diversity and multiplicity, including collective land ownership, homestead ownership and use right, peasant housing ownership, peasant residence right, etc., because different rights involve different subjects. Therefore, the circulation of the right to use the rural homestead will involve the rational distribution of the interests of the circulation among different subjects, and because our country is in the historical stage of breaking down the dual structure between urban and rural areas and speeding up the realization of urbanization. The interests involved are more complex and pluralistic, which aggravate the difficulty of the reform of the right to use the homestead and the construction of the modern circulation system. Through the analysis and study of the investigation materials, this paper finds out the most prominent problems in the circulation of the right to use the homestead in Huaxi District, and puts forward appropriate solutions and suggestions, with a view to establishing a more perfect circulation system of the right to use the homestead in Huaxi District. In order to improve the utilization rate of rural land, increase farmers property benefits to provide institutional protection. This paper is divided into four parts. The first part is the introduction, mainly on the background and significance of this paper, research status, the understanding of the concept of homestead use right. Under the background of our country breaking out the dual structure of urban and rural areas and deepening the reform of rural land system, the research in this paper is in line with the present situation of social and economic development, which is conducive to improving the utilization rate of rural homestead in Huaxi District and increasing the property income of farmers in Huaxi District. Combing the current theoretical research and legal policy has deepened the author's understanding of the homestead system and provided help for the better completion of the thesis. Only by fully understanding the historical change process of the homestead system can we better understand the connotation and characteristics of the right to use the homestead in our country. This part is the premise of the successful completion of this article. The second part of this paper briefly describes the basic situation of the investigation, through the case files of Huaxi District Court, a questionnaire survey of some villages in Huaxi District and interviews with grass-roots staff in Huaxi District. It is the foundation of this paper to master the rich materials about the circulation of homestead use right in Huaxi District. The third part of this paper is the key part of this paper, this part of the Huaxi residential land use right in the initial circulation, circulation again, dispute resolution encountered problems and related suggestions are described in detail. We should advocate the paid nature of the initial acquisition, improve the status quo of the lack of homestead through the construction of rural apartments, adhere to prudence, step by step, and appropriately open the attitude of homestead circulation, strengthen the management of the homestead, and improve the judicial solution to the disputes over the Homestead. The fourth part of this paper is the conclusion, on the Huaxi residential land use right circulation issues are summarized.
