【摘要】：孤兒作品作為圖書館館藏資源中十分重要的部分,其數(shù)字化利用將對圖書館的數(shù)字化建設產(chǎn)生重大影響。為了便利孤兒作品的數(shù)字化利用,各國大都通過立法的形式建立了孤兒作品利用制度,我國著作權法第三次修改草案也增加了相應條款,擬解決對孤兒作品利用的需求和無法授權之間的矛盾。但根據(jù)各國的通行做法和著作權法修改草案的規(guī)定,圖書館若想使用孤兒作品,其前提是進行了合理勤勉的檢索,且并未找到可聯(lián)系的權利人。而對于合理勤勉檢索的標準要求的不同,將決定圖書館究竟能否使用作品。合理勤勉檢索雖看似是使用人的一項義務,但是否具有完善的信息檢索平臺也十分關鍵,而這也是我國在建立孤兒作品制度時必須予以完善的重要方面。
[Abstract]:As an important part of library collection, the digitization of orphan works will have a great impact on the construction of library digitalization. In order to facilitate the digital utilization of orphans' works, most countries have established the system of using orphan works by way of legislation, and the third revised draft of the copyright Law of our country has also added corresponding provisions. It is intended to resolve the contradiction between the need for the use of orphan works and the inability to authorize them. However, according to the common practice of various countries and the provisions of the revised draft of copyright Law, if the library wants to use the orphan works, the premise is that it has carried out a reasonable and diligent search, and has not found the right owner who can be contacted. The difference in the standard of reasonable and diligent retrieval will determine whether the library can use the works. Although reasonable and diligent retrieval seems to be an obligation of the user, it is also very important to have a perfect information retrieval platform, which is also an important aspect that must be perfected when establishing the system of orphans' works in our country.
