【摘要】：就民法所調(diào)整的人身部分而言,主要有兩種學(xué)說:一是"人格權(quán)法體系",二是"人身權(quán)法體系"。2002年的《民法(草案)》第四編將"人格權(quán)法"獨(dú)立成編,該學(xué)說目前處于通說地位,但存在局限性。如何協(xié)調(diào)人身權(quán)法、人格權(quán)法與我國現(xiàn)行的"人身關(guān)系法模式"之間的關(guān)系是涉及到未來中國民法典采取何種立法模式的根本問題,在編纂民法典的今天,需要加強(qiáng)對這一問題的研究�；谖覈臍v史傳統(tǒng),結(jié)合我國民事立法、司法實踐以及時代發(fā)展對民法提出的新要求,應(yīng)當(dāng)堅持"人身關(guān)系法模式",該模式涵蓋"人身權(quán)法獨(dú)立成編"或者"人格權(quán)法獨(dú)立成編"在內(nèi),并克服兩者之不足,是其更新發(fā)展。
[Abstract]:As far as the part of the person regulated by the civil law is concerned, there are mainly two doctrines: one is the "personality right law system" and the other is the "personal right law system". The relationship between the legal system model and the legal system model is a fundamental issue concerning what kind of legislative model China will adopt in the future civil code. Today, it is necessary to strengthen the study of this issue in the compilation of the civil code. This model covers the "personal rights law independently compiled" or "personal rights law independently compiled" and overcomes the shortcomings of both, which is its renewal and development.
