微博名譽(yù)侵權(quán)責(zé)任認(rèn)定法律問(wèn)題研究

【摘要】:早在2012年,我國(guó)就已經(jīng)成為微博用戶最多的國(guó)家,近年來(lái),微博發(fā)展方興未艾,與此同時(shí),微博名譽(yù)侵權(quán)的現(xiàn)象層出不窮,然而,對(duì)微博名譽(yù)侵權(quán)的責(zé)任認(rèn)定還存在很多待補(bǔ)充之處。除引言和結(jié)語(yǔ)外,本文共四章。第一章由微博名譽(yù)侵權(quán)的典型案例引出的相應(yīng)的法律思考,指出當(dāng)下微博名譽(yù)侵權(quán)責(zé)任認(rèn)定中的突出問(wèn)題;第二章可分為三部分,首先是責(zé)任主體方面,從微博發(fā)布者,微博轉(zhuǎn)載者、評(píng)論者,微博審核者這幾個(gè)主體來(lái)進(jìn)行討論,論述了其成為侵權(quán)主體的法律依據(jù)和理論依據(jù)。其次是責(zé)任構(gòu)成方面,從侵權(quán)行為、損害事實(shí)、因果關(guān)系、主觀過(guò)錯(cuò)加以論述,其中重點(diǎn)寫了主觀過(guò)錯(cuò)的認(rèn)定。最后是責(zé)任形式方面,主要有停止侵害,恢復(fù)名譽(yù)、消除影響,賠禮道歉,賠償損失等,并對(duì)其中學(xué)界爭(zhēng)議較大的賠禮道歉和賠償損失這兩種責(zé)任形式進(jìn)行了重點(diǎn)論述。第三章,綜合概括了微博名譽(yù)侵權(quán)免責(zé)事由,首先是內(nèi)容真實(shí),其次是對(duì)“公眾人”(公眾人物及公眾法人)的適度監(jiān)督與批評(píng),最后是其他免責(zé)事由,囊括了正當(dāng)行使權(quán)利,第三人過(guò)錯(cuò),依法執(zhí)行職務(wù),合理引用,受害人同意等。第四章,從立法、司法、實(shí)踐三個(gè)層面提出了微博名譽(yù)侵權(quán)責(zé)任認(rèn)定的相關(guān)建議,希望能厘清微博名譽(yù)侵權(quán)責(zé)任認(rèn)定中較為模糊的問(wèn)題。
[Abstract]:As early as 2012, China has become the country with the largest number of users of Weibo. In recent years, the development of Weibo is in the ascendant. At the same time, the phenomenon of reputation infringement of Weibo is emerging in endlessly, however, There are still a lot to add to Weibo's responsibility for reputation infringement. In addition to the introduction and conclusion, there are four chapters in this paper. The first chapter draws the corresponding legal thinking from the typical case of Weibo's reputation infringement, and points out the prominent problems in the cognizance of Weibo's reputation tort liability at present; the second chapter can be divided into three parts, first of all, the subject of responsibility, from Weibo publisher, Weibo reprinted, commentator, Weibo examiner these several main body to carry on the discussion, elaborated its becomes the infringement subject the legal basis and the theory basis. The second is liability constitution, from tort, damage facts, causality, subjective fault to be discussed, which focuses on the identification of subjective fault. Finally, the form of liability, mainly to stop infringement, restore reputation, eliminate the impact, apology, compensation for losses and so on, and the academic controversy of apology and compensation for the loss of these two forms of liability are discussed emphatically. The third chapter summarizes the reasons for Weibo's reputation infringement, firstly, the content is true, secondly, the proper supervision and criticism of "public person" (public figure and public legal person), and finally other exonerations, including the proper exercise of right. The third person's fault, the execution of duties according to law, reasonable reference, victim's consent, etc. The fourth chapter, from the legislative, judicial, practical aspects of Weibo's reputation tort liability identification of the relevant recommendations, hoping to clarify the relatively vague issues in the cognizance of Weibo reputation tort liability.
